Default Legal status with NF and roger clarke MS

can they legally claim they are NF europe when i have that as a registered company name and business

Are they liable ?

Contact them direct & discuss with them offline; I doubt us ranting & raving on here will do anybody any favours & will certainly prejudice any court action

FFS I'm sure RCM would have looked into or been advised that the name was free to use (or whatever), though us chewing the fat won't give you RCM's answer. Only they will know about that & why not call them tomorrow & find out for definate rather than getting many other posts about what is & what isn't....that doing nothing to aid your position....

common problem unfortunately.......................there is also another company trading cars that have a very similiar business name to myself!!

been trading longer than them, but sh*t happens....................

Myself I would contact them via solicitors letter drawing to their attention the facts of your Ltd company, previous trading History in that name etc. After pointing out the legal standpoint and your strong case. I would invite them if I was not continuing to trade under that name to purchase the trading name and Ltd company from me for a large fee or risk a legal fight and all the implications that it brings.
I am sure that if you was to contact Companies House they would prohibited another entity from using NF europe LTD if it is already a LTD company that is currenty active and not dissolved or struck off.

think you will find that "NFeurope" is simply used as a web address in this instance by RGM..........................not sure you have any call on them using this???

RCM are trading it as "Nitrous Formula Europe" not "NF Europe" .
The website is www.nfeurope.com and they have title on that.

The old site www.nitrousformula.co.uk seems to be dormant so there is no clue as to any conflict of distributor claims.


A classic and at first site, quite legitimate way, of getting around any title or claim that a previous distributor may have had over a product and its marketing.

Were you the original distributor or have you speculatively bought the NF Europe name?
