Damn unlucky At least the accident wasn't your fault though. Do you think it's a write off though?

Where there's blame there's a claim! Like you lot wouldn't do it given the chance.

Yeah I suppose so, in the face of being able to make some serious money for mods it would be very tempting to go overboard. Plus you've obviously got to source a hire car, take time off work etc, suppose its only fair, plus all those sleepless nights worrying and having to force yourself to get back into the driving seat, loss of business etc

Spurious claim?... Wouldn't do it, there's already too many bogus claimers, who quite frankly deserve to be on the receiving end of a trumped up injury claim .

Being the claimant you have a legal duty to mitigate your losses, therefore half the above would have to be reasonable and also proved, eg the worry, fear of driving etc. Given the compensation culture around nowadays any insurer worth their salt would actively try to reduce what you are claiming for by using medical experts etc to examine you.
being in the industry myself I know that it is very near impossible to fool doctors etc into believing half of what you would be trying to claim for, dont get me wrong it goes on but it is getting harded and harder to prove.

Nope, I wouldn't.

A Woman in a polo pulled straight out me about this time last year, and in her panic when she realised that I was on-coming she hit the brakes and stopped in the middle of the road, leaving me no way of getting round her as she's blocking both lanes

I wasn't going fast though so had time to scrub as much speed as possible of before steering the car (Focus) up onto the hedge and along the top of it until it lands upside down in the hedge

Managed to miss her car totally so there was no big impact, although the deceleration of hitting the bank was enough to set Airbags & pre-tensioners off.

I was fine, was at work an hour later but the car was written off. I could of done the aforementioned neck brace & big claim though, it was a nasty crash, could have sued her for ££££££££ loss of earnings etc, but as I was fine why should I??? The compensation culture for people not really injured is driving up the cost of insurance for all of us!!

I came out of it with a nice sum for my Focus (was written off due to floorplan knackered) which having just changed jobs and doing lots less miles per month meant I could afford to get my dream Impreza turbo

Compensation culture is going to whittle away at the "dangerous" things we can do in the UK (I do lots of trackdays on my bike) as the organisers won't be able to afford the insurance

So no, we wouldn't all do it if we had the chance, some of have principles.

Fair play to you then but the next moron that runs into me will be getting a major claim against them. Obviously only if I'm injured.

.... you don't have to claim through your insurance, you could always go after them through the courts using your own money......

.... I read in the Times at the weekend that you don't need insurance providing you leave £25k at the local court's office & have suitable means to meet any claim against you.....

I WONT be claiming for any whiplash garbage as me thinks our premiums are high enough and i escaped totally unhurt, but the driver of the saxo and his two passengers wern't so lucky, all three have been taken to hospital

just to clear it up,i was travelling along a national speed limit country road when this saxo was sat waiting to turn accross my lane, but for some strange reason he didnt wait for me to pass, instead he obviously thought i was further away then i actually was,Anyway i now have to enjure driving around in a corsa hire car until the insurance/police investigation is complete(the police are investigating it as three ambulances, two fire engines, five cop cars and an air ambulance turned up)

Me thinks my scoob is going to the great scrapyard in the sky

OH and before anyone says it"no it wont t-cut out" will get some piccies of damage as and when they give me access to my baby scoob

the missus is a solicitor for a firm that specialise in RTA's, and quiite often has talks with medical experts. Apparently, it is nigh on impossible to disprove any neckpain, and the people that know how to abuse the system of claiming have cottoned onto this! That neck does look a little sore though!!!!

If you claim, you will be sent to a medical examiner (an independent), and they will advise on the extent of injuries and how long symtpoms will last for, the compo you receive will be based on this.

when I got T-Boned in my Scoob, I had <genuine> whiplash. I DID claim against the other driver took me about 6 months to get over it, and that was when the legal eagles sent me to see a specialist. They CAN tell if you're taking the p1ss - I asked him outright. Was upfront and honest and said that it had hurt but less so at the time of examination.
The Doctor said that there was evidence of bruising, plus after looking at the accident photos (no Police etc), he was suprised I'd not received worse injuries. A real testiment to how good the Scoob is

As a result I received an acceptable amount - not thousands, but enough.

It IS worth doing, but ONLY if you're injured, as the professionals can tell.

The problem isn't people who do genuinely get injured. The problem is people like XtremeScoobies suggesting 'A neck brace a& compensation claim me thinks........' even though the original poster made NO reference to being injured whatsoever!

The police tell me the "old fella" ha-hum is ok and in no danger(until he has an heart attack when he gets the bill for repairs)

And if they write it off then i feel i will be buying a mini metro!

Na,probably get a sti8 from motorpoint on a pcp style jobbie(depending on payout)

One thing I gained from my experience mate was just how flexible the womans insurance company were with the amount to pay, was expecting a real battle but after the obvious stupidly low first offer, I went back armed with proof of the low mileage, photos of mint condition, report from my dealer as to how much it would cost me to get a replacement car of same age / condition they came back with a sensible offer that was more than I ever thought I'd get..... hence the scooby now parked outside

Good luck!!

Sorry to hear about ur car but glad ur ok.

I went to a company called Helphire when someone drove into my Scoob last year whilst it was parked. They provided me with an x type Jag as a replacement car whilst mine was off the road and claimed the cost from the other drivers insurance. I found them to be very good.
