Default £1175 that lasted 1500 miles :(

Guys, im not trying to put down the breaker here, but just want peoples opinions.

After my 3rd gear on the wrx went, i paid £1175 from a "well known" breakers for a P1 5 speed and rear diff. I had this fitted by my local garage, who did a fairly good job. Instantly i noticed a slight whine when i first drove it and backed off the throttle and called the breakers to explain. They told me this was common and that it was probably prop bearings, nothing to worry about.
Anyway i did a rolling road on saturday, which made 280bhp and a trackday on Monday. It was a very wet day at goodwood, so couldnt totally thrash it.

I noticed the whining has become very noisy now. Feel a little upset because i have covered less than 1500miles in total. Called the breakers to be told there is no warranty.

Naturally i feel a little unhappy, but respect the fact that i have done a track day.

What would you feel in my shoes?

sorry to hear about your gearbox, i would offer the breakers a chance to refund your money or offer legal action for supplying faulty goods, warranty or not you are a consumer and you have rights

Which rolling road did you do as you dropped out of the Gforce one with car trouble last saturday

Andy,

I did powerstation, which i didnt drop out of due to car troubles, but because i needed a 4 wheel alignment done. I did however notify people that couldnt make it.

Where do i stand legally?

When my gearbox went on my old scoob i rang a "well known" breakers (could be the same as yours) in search of a 2nd hand one. was quoted £500 ish + vat & del (UK MY98 Box), i asked about warranty and was told start up only - ie once its in the car and the car moves the warranty is over.

In the end i took my fecked gearbox to rally colin in reading (07771767874 BTW) who then stripped it & reconditioned it for £300 all in, i was assured by colin if i had any problems do not hesitate to bring it back. Anyway, fitted my newly refurbed gearbox and reverse wouldnt select - phoned colin, who took my car, removed gearbox, re-stripped it, re-built it, replaced it, re-filled with oil all free of charge as promised. Top Bloke IMHO.

I know colin quite well, hes good like that
I suppose thats what it boils down to then, forking out for a rebuild

I guess so mate, TBH i think you've got more chance platting snot than getting a refund from a breaker.

Yes i know you told drumsterphil you couldn't make it, i was just curious which rolling road day you done, you must have seen fangoria run his 400+ bhp scoob as he done powerstation then g force the same day.

legally......? take the rebuild advice as legal action will cost you more, thinking about it as its a second hand part i think they only have to give you 14 days warranty but it may be less if i am wrong, good luck anyway

I think if the breaker doesnt give you a refund - name and shame him!

If they sold you a perfectly working gearbox, i cant see it going bust so quickly. Your not running big power through it (about the same as p1) so gearbox should be fine

Unless it was f*cked in the beginning

Cough. £1175? Was this rebuilt, or just straight out of the car?

I'd feel a bit of a prat. Sorry to be blunt, and I know it's an unfortunate situation, but you've really got nobody to blame here but yourself.

You made a couple of mistakes with this purchase. The first, and most important one was not obtaining some sort of written warranty up front, especially given the amount of money you paid.

Without the written warranty, the breaker will take the attitude that the box was sold as seen, and are thus perfectly within their rights to act the way they have done. Consequently you have little legal legal leg to stand on with regard to obtaining any compensation from them.

Probably the best course of action would be to get the box professionally rebuilt, and, while you're at it, ask the engineer to report on the nature of the damage.

If, in his opinion, the damage was caused prior to your purchasing the box, send a copy of the report and repair receipt to the breaker with a polite request that they contribute a fair portion of the cost of the repair.

If the breakers are straight ahead, you may be lucky. If not, it'll be up to you to decide whether you want to fight the breaker on the grounds that what you were sold was not fit for purpose. You'll probably find though that the cost and hassle involved in going legal would be unlikely to be worthwhile.

Have you paid by card?

If so get intouch with the card company and explain the situation.

Was a period of warranty given before purchasing?

If you are within that period then fight with them.
BTW,mentioning a track day will put yourself in it.
£1175 is too much to pay for a s/h g box.It should come with a decent warranty at that price.
Sometimes a high price dosent mean high quality.

Sorry to hear about your missfortune,but dont feel like a prat about it,because getting ripped off is not so uncommon.
It can happen to anyone no matter how clever they think they are.

£1175 for a gearbox are you kidding ??

I only charge £900 for a dccd version that's the highest we charge for a used 5 speed, most are between £450 and £600 and come with a 6 months warranty.

I'd be making BIG noises about getting my money back. And if it was us that had let you down - we'd be paying to keep you quiet.............

David,

I phoned your place twice prior to making this purchase. At the time you didnt have the parts i needed
I only wish that i had waited a little longer now. Paid for the box with my credit card on 9th March and had it fitted a week later.
Im tempted to contact my card company and discuss this with them.

Its worth noting that this breaker told me the gearbox was off a P1 2000 W reg that had covered only 20,000 miles!

Surely it should have lasted more than 3 weeks.

WR1 ant, i got the matching diff with this too .....

Money back no issues on this.

I know the breakers you got this from and they are very reasonable mate.

Give them a call and discuss it with them.

Doesnt the P1 box have a 1:1:1 drop gear and putting this into a WRX will cause issues with the front diff? Or is this just UK cars.

Sorry forgetting front diff is housed within gearbox doh!!!!!!!!!!!!!
