ARRRGGGGHHHH!!!

Dude in white van, indicated right, pulls up onto kerb on right. Theres a car parked on the left to I go to pass him through the gap. See his reverse lights come on so i stop asap and WHAM - he reverses back into a drive on the right - swings out and clonks my headlight and wing with his left front bumper. My lights gone ans wing dented - he's just got a scratch on his bumper.

He apologises and says he didnt see me when he reversed.

Ive got a witness and some photos.

Get this - he's told his unsurance firm IT WAS MY FAULT!!!

What can i do?

I want to take this guy to court if he continues with this line.

Any one know where the law stands on this - if he persists by claiming it was me can i take him to court for damages? I have a witness and photos!!! i dont want this to go on my record as my fault!

he's apologised and said he didn't see you - that's an admission of guilt I believe. Did you witness hear that as well as see it?
Make sure that your insurance company gets the witness details. Let your legal protection do the rest.

Similar thing happened to my friend. Stupid woman illegally parked, reversed onto main road into my friend. only scratches on bumpers. he wanted her to pay cash to save hassle, she said yes and later changed her mind. now they've gone thru insurance and guess what, shes told them he hit her!! he has no witnesses or evidence so its bound to go knock for knock. hes had to pay out £450 excess for a scratch you could do yourself with a touch up pen. He'll also lose 2 yrs NCD and so might not be able to afford to get insured on the car next time round!

Common sense would say that if you were stationary at the time of the impact then whoever was the moving party is to blame.

But lets face it, common sense and the law dont always go hand in hand.

Jza - unfortunately your wife would be counted as biased and probably ignored by the insurance company. Was there anyone independent that saw/heard it.
Get someone to look at the car - might be able to tell my the marks on yours that it was caused by him reversing into you by the angle of collision etc

if you've got witnesses you should be fine... i'd make a number of quality sketches of the scene, before and during the accident if you get what I mean. (showing vehicle paths, landmarks, roadsigns, direction of travel etc.)

If both parties dispute I think the very worst you can expect is a 50/50 fault/no fault against you. A bummer I know - hopefully it won't come to that as both insurance co's will see just who's fault it is from the pics, the damage, and the witness.

do you have any pics as proof? I learned this lesson the hard way, and now carry a Boots disposable camera in the boot compartment - 6.99 and worth every penny!

Got picks - but not of the cars i a tanlge as the dude moved forward and parked. I got the photo's of his car and mine. The witness saw it happen - so surely that would go against this guy?

Only if the witness isnt your wife. It sounds like you'll be ok.

Even if the witness is your wife, it still counts for something. I had a bloke take me to court after he went into the back of me. My girlfriend was the only witness, and she was required to give a statement in court. You should be OK with what photos and witnesses you have.
