No MOT who gets done ?

Monday morning I had an accident in my works van and got 7 days to produce my documents to essex police,
when going into my office to get the MOT and insurance I found out that the vans MOT ran out in July.
Does anyone know if I can get points or a fine being the driver of the van or will my firm get a fine ?

I'm not sure with these things but there is a chance the firm may be liable as well. Its called 'use, cause & permit'. Initially you are liable as technically you should have checked the docs before you set off - however if the company knew (or should have known) that the mot was out, then you could work on the angle that they have 'caused' you to use it knowing that there was no mot.
I'm 99% certain you won't get points and it should just be a fine - round about £30

MOT is down to you, it's none endorsable but you will get a fine and a slap on the wrist! Get your company to pay if and when you hear anything. Takes ages for something to come through!

An anecdote that may or may not be relevant:
My mate got stopped for speeding in a company car, and it turned out his company hadn't renewed his insurance.
In the end, company took the fine, no problems for my mate...

You're using the vehicle, cos you're driving it.
Your company use the vehicle as its being driven for the benefit of the business.
Its not "cause" as there's no duress on the driver.
It could be permit, however the "use" is more common.
I personally think that its not in the public interest to pursue, but that's my own opinion.

The 2 separate offences are:
Driver: Using a motor vehicle on a road without an MOT
Company: Permitting (driver) to use the car on a road without an MOT.
The Police may or may not pursue the company, but the driver will get done.
Neither offence carries endorsement, penalty varies by postcode, circumstances and whether it's a woman magistrate or not.

Sorry for not mentioning this earlier, but what's to stop you getting a new MoT and handing that in? Do the documnents state 'valid at the time of the incident', or just 'valid'?
Agree that no MoT would imply no insurance, but since you wern't speeding you're probably relatively safe

Of course, because no MOT itimates an unroadworthy car, and you cannot insure a car which doesn't meet government motor vehicle regulations.
Granted the MOT is only of any actual use on the day it is issued, but it is still the legal requirement for insurance and tax.
