Mail Order firm will not take back CD Multi-changer (I ordered the wrong one)
#1
as in the title, the multi-changer I have is a Sony CDX 727 10CD job, It will not interface with the radio in my car. The mail order firm will not take the goods back and refund me. Their argument is that there is nothing wrong with the goods and it is my fault that I ordered the wrong item.
What are my rights?
If I'm buggered, it's for sale at £100 + p&p
Cheers,
Dave

hmm, I thought that statutory rights stated that you could return the goods for full refund within 28 days of purchase for ANY reason, eg; wrong shade of black.
not 100 percent sure on this though.
anyone wanna clarify.

Unfortunatley the company as an company or shop does, have the right NOT to give refunds, NOT to give exchanges and NOT to give credit notes UNLESS the product has a manufacturing fault. If you were delivered what you ordered, then sorry mate...your stuck!!!!

As far as I am aware, it is part of your statutory rights to be able to return a mail ordered product with 14 days of purchase if ordered incorrectly or faulty. Best bet is CAB mate, they'll help.

Best bet is to phone them again and ask nicely if you can return this one and order the one you meant to get.
Say you're quite happy to pay a restocking fee (this is usually 10 to 25% depending on the company!).
If you got what you ordered then I'm afraid there's not a lot you can do.
There's a reason some of the mail order places cost a lot less and you usually find out when you need some after sales service.....

If you got what you ordered then the company has fulfilled its obligations and satisfied the contract.
If the goods are fit for purpose, ie. work as they should then there is no come back.
A clever company would take it back and may charge a handling fee - but they then have what is to all intents and purposes a second hand item that they cannot sell on as new.
Sorry mate - you should have made it a condition of the order that it actually will work with the head unit - then you would be home and dry.

David,
Did you order the 'wrong' thing by virtue of incorrect information provided by the company? or was it simply your fault.
If the former, then if their website/whatever has incorrect info then you might have some grounding on getting the item returned and refunded, if the latter then I think you might be stuffed.
not an expert so feel free to ignore me.

I'm pretty sure that the Sale of Goods act does have a clause in it that gives mail orded goods a return period. It's why catalogues and especially argos take returns bcak if there is nothing wrong with them.

cheers guys, it is totally my fault, I thought it would interface with the VW headunit (because when I bought the car the sales guy said the headunit was SONY badged as VW, he was wrong), the mail order firm was better priced than the same unit in the dealer.
The unit was advertised in the dealer extra booklet, but I should have noted that it required a headunit upgrade to SONY as well !! DOH!!!
It's now for sale in PRIVATE section.

The MOPS (Mail Order Protection Scheme) says...
Any company that sends out goods by mail order must give the customer a full refund if the goods are returned within 28 days.
For whatever they are returned.
If your retailer does not recognise this scheme (we do), I'm not sure of your rights, but this may still be your right anyway.
If the company advertise in any mainstream magazine, it will be a requirement that they do operate under this scheme.
If they let you down, speak to the mag. They will withdraw the advert.

As PsLewis found out - most firms play games saying "no" until things get messy.
Explain you still want the correct changer and will pay the cost of return as it was your mistake. Then find the right one and get it in replacement of the wrong one (from the same company).
If they still wont budge, Put it in writing to the Boss.
Then get serious if you are indeed within your rights!!

What a few people have already said makes most sense.
Give them a call and offer to pay a restocking fee.
If you haven't ordered one already, order one from them on the understanding they'll take the Sony one back.
They're just being lazy.
I think you need a Panasonic CD for the VW headunits?

It seems a few people are not aware that "The Consumer Protection (Distance Selling) Regulations" permits, in *most* circumstances, a refund to the purchaser for *any* reason (not just faulty goods). There are exceptions e.g. sealed computer software etc.Cooling off period is 7 days.
The OFT should have chapter & verse.
