Default Getting really pi55ed off with local dealer

Hi

I bought a new car just over 2 weeks ago. As part of the deal they took my RS4 in as part ex and settled the remaining debt owed on that car..
However a couple of days later the finance company took another payment from my account for the RS. The Dealer acknowledged, had already accounted for this on their finance (thereby settling direct with my old finance company, but less a further payment) and said they were in the process of reimbursing this to me. All in the hope of saving me any interaction with my original finance company.
"Great"! Or so I thought...

Now 2 weeks later, having phoned on several occasions I've been promised upteen times that £419 will be paid back into my bank account.. Alas nothing!
Today I called suggesting that as they said last Sunday "it could take 3 working days" that we are now in day 4..
I spoke with the Finance Manager and he assured me the payment had been processed and should have landed by now, and if not it should be in my account tomorrow.

My response:
"Ok, if it is not in my account by tomorrow lunch time I will come and collect it from you in cash. Don't even think about any other method from then as I need the money before the weekend".

Hopefully it will be in my account tomorrow. If it's not then I will be parking my vehicle in the middle of their one-way system within the dealership and will not move it until I have the money, in cash, in my hand!

Is this unreasonable?

Note, hopefully it won't come to this but I'm at the end of my tether now!

Nick

have you confirmed they paid it to the correct account?

BACS can take 4 days sometimes a little longer so i would imagine it will be on day 5 due to them processing on your day 1 (if you get what I mean)

Go to your bank and claim it back under the direct debit guarantee.

Thanks but the 5 day bacs thing is one thing but for all of last week and I was expecting to see payment too. His comment last Sunday suggesting 3 days has been taken literally. No more excuses in my book.

They can't keep shifting the goalposts in other words.

The account they are paying into is the same as the one I paid a large deposit from. Will double check tomorrow though before I change into the hulk

ive seen someone protesting like yourself, they parked outside the dealership and held up a placard with "Dealer Owes me Money".

They coughed up the cash within 20 mins of him parking up. Go for it fella, get someone to photograph you with the placard too.

Give them the benefit of the doubt of it being there today, they can do an electronic payment in seconds or could have least given you a cheque....

Hi,

What car did you buy that you traded in a RS4 for ?? Im assuming it must be high end, so an angry customer sitting in thier showroom, perhaps on a busy Saturday, wouldnt be good for business.

Telephone calls end the moment the phone is put down, and often forgotten. Standing in front of them, expressing your angry, and demanding the manager seem to get the ball rolling more.

I'd love to be there to see all this go down

I'd probably leave it a few days tbh.

I hope they play fair with you. Very bad to behave like that.

Good news. On friday the money was paid by cash. They stalled for a while but i insisted that i had to have it on that day. I signed an agreement to declare that at soon as the original payment lands in my account that i would pay it back to them... At last that payment landed in my account yesterday. Grrrrr! I had a feeling it would.
It may just take me a few weeks to pay it back to them.. I'll sort it tomorrow just to demonstrate how payments can be made within a reasonable time.

The new car is an M3 and it's awesome. I'll post some pictures at some point.
Thanks for all your replies.

Nick

You've just bought a new M3 and you're fretting about £400?

Er yes. Why wouldn't I? It's a lot of money. Just because I bought a new car, it doesn't mean I should be prepared to wait so long for £400.

I agree, my point was that you can afford to buy a new M3 and therefore whether the money was in your account on Friday or Monday shouldn't really cause you massive problems.

It's not like they were not going to pay you back.

Ant, I was responding to Hanley mate .

Hanley the real point was the long wait and whether or not I'd ever actually receive it as it did feel like they kept fobbing me off.
All sorted now anyway
They have agreed to discount on first service or cost price for any add-ons I fancy. I'd quite like a little front splitter

With regards of any cases where fobbing off maybe apparent, all phone/verbal correspondance should be typed into a letter and sent to the appropriate person at the dealership. Politely and factfully (no opinions or abuse), outlining the situation, the conversation that ensued and promises that were given to resolve the discussed issues.

Sent recodered (signed for) delivery of course.

Too often do phone calls get intentionally "forgotton" or not logged, along with the promises that go with them.

For example to make sure you get the discounted service and cost price "add-ons". Bearing in mind your Beamer's next service could be 18months away - they WILL forget

Not sure why you got so worked up about it tbh. A day or two here or there, what's the big deal? You were always going to get the money, there was no way they could/would have cheated you.
