Default Let the opinions commence! (Drinking while driving)

Cycling home tonight - I've come up behind a line of traffic waiting for some temporary traffic lights.

The guy driving the car in front of me takes a can of Stella out of the drinks holder and takes a slurp.

It's a line of traffic - it's come to a halt, so I pull up alongside of him and make the following suggestion:

"I'll make you a deal, you pour that drink away and I'll not report you to the Police. How's that?"

He agreed, really quickly. His girlfriend looked confused but he's telling her to pour the drink out of her window - so she does. Whole can - on the road on her side.

So, was I righteous pillock, or doing my bit?

Oh yeah, and I had a helmet cam, so the whole thing is captured for posterity (and if anyone wants to get into the whole debate about Helmet cams for cyclists - start another thread... I got mine for the fun stuff)

keeping the clip off air at the moment as it clearly shows the driver, the car, the number plate and everything.

I could report it to the Police and have him charged with due care (there is no offense for drink driving - people mistake this for driving while under the influence) and I'm in two minds to do so at the moment.

I'm not sure I understand what he's done wrong?

a) You don't know he was over the limit.

b) He was drinking from a can whilst stationary. Is that a crime? Have you never eaten or drunk something in a car?

I'm not saying you're wrong - I just don't understand what you're accusing him of.

Actually having a drink WHILE driving is due care and attention (oh and the car was moving - albeit slowly)

I had a chat with the Police about it and they explained what the actual crime was (as above)

I would have shoved your camera where the sun don't shine, in all honesty ................... !!

He can drink whilst not moving.

He can drink whiskey if he chooses to.

What he cannot do is DUI. You have zero evidence that he was.

I am truly staggered that:-

a. You told him to empty the drink, and,

b. He actually did!!

defo did the righ thing matey, i must admit i sometimes feel guilty drinking my mcdonalds coffee when out on the road for fear of having a bump, so a can of stella is a definite no no

Oh dear. But he was drinking a STELLA whislt in control of a motor for crying out load. How do we know he hadn't sunk into another can before hand etc.

Loads of people drink soft drinks and tea/coffee whilst driving. I believe it is only an offense if the officer reasonably believes you are compromising your control of the vehicle.

You ever sup out of a water bottle whist cycling?

id have told him to **** off whats it got to do with you suprised the guy didnt get out and knock his helmet off with his silly camera to many morons with cameras riding bikes i do condone drink driving gonna get a camera fitted to my car so i can post up the idiot cyclists in there crimes rant over

I always tend to stop to be honest (good excuse for a breather). Plus not all the same laws apply to bikes - you can actually cycle while over the legal driving limit (which IMO is stupid) but when you do, you can be charged with drunk and disorderly but NOT DUI


Just to clarify - he WAS breaking the law - driving without due care. If a copper REALLY wanted to be arsey he could charge you with due care for eating a sweet while driving. (the actual act of unwrapping it and putting it in your mouth would qualify)

Every other day you read about person X who approach person Y over something they person Y was doing they considered wrong, immoral or illegal. Invariably, person X ends up stabbed.

Personally,I just let the world around me get on with it. If I saw something that really concerned me I would report it to the relevant people.

If he was irrresponsible enough to drink the Stella whilst driving does it not tell you something about his mentality.

because by the time I reported it, he was well away and impossible to find (we were less than a mile from the M1). Plus it would be impossible to prove he was drunk while actually driving the car - this did come up in conversation with the Police.
