Data protection help? Three mobile!
I'm having a dispute with 3 mobile at the moment regarding data protection, are there any solicitors that could advise me of where I stand?
I have a contract with 3 that my daughter uses, the contract ends in January 2011 and I phoned (from my work phone) a month ago to ask the process of cancelling the contract. I got cut off from the helpdesk and they phoned the mobile back which my daughter has and told her I wanted to cancel the contract and she has binned the phoned, stopped talking to me and her mother has got her another contract! The relationship was already strained and this was all I needed, I was looking to get her another phone for xmas!
I do not see why after 3 have breached data protection by divulging information to my daughter who is not the account holder that I should pay the remaining few months.
I wrote to 3 and they're ignored me so I have just sent the same complaint letter to their CEO. Their helpdesk told me that 3's stance on data protection was as long the person that picks up the phone can answer the security questions they will talk to them! Sure the first question is are you the account holder??? My 17 year old daughter sounds nothing like me...a 39 year old man!!
Does anyone have any experience of this and where I stand.

If your daughter has the contract then surely it is not legal is she was under 18 when she signed it.
Otherwise surely the contract is in the mothers name and her responsibility.
Either way your daughter is clear of it unless she signed to say she was 18 when she took out the contract in which case she lied/mislead but she will still be free of the contract but possibly open to prosecution from 3 although not very likely.
Find out the facts from your daughter and/or the mother would be my advice.
