She has obviously had previous convictions/incidents concerning the shop and she denied the offence

It does seem that the legal system in this Country is really odd.

Like the sad sad story of Fiona Pilkington.

I've phoned our Police up but I got the its not our problem, have you tried the Council. Now I thought that any criminal law breaking was the Bill?????

Sorry but much as I used to have great regard for the law, I think its now a total farce. If its a tough problem, they turn the other cheek, if its a pensioner or motorist they turn up in force.

Terminator - It was a near riot, you can't take chances. You often get organised sections of the crowd (out to cause trouble) who will have a couple of people to distract officers (like she was doing) whilst the rest of the crowd attack.

You also can't start simply arresting people either as before long you leave that unit short of numbers and vulnerable. PC Blackelock was an example of this

Plus as well, if you decide to use the batton - you have to hit as hard as you can, you can't just lightly tap someone

I'm genuinely interested in why you need to batter a female? Here's an alternative - ignore her? What's she likely to do?

How can you ignore someone who is repeatedly in your face and distracting you from the other protestors around you?. More importantly, how do you ignore someone who poses a potential threat to you? In such a demonstration, how do you identify such a threat? Do you think that every police officer knows every person who could possibly pose a threat to them, both from the UK and abroad.
During the 1990 poll tax riot, the offender who put a scaffolding pole through the window of a BTP Peugeot, narrowlingly missing the driver was Dutch.
Until you have been in a riot or near riot, you will never have an idea of the confusion, thoughts and fears that go through your head.
Believe it or not, police officers have a survival instinct and are just as likely to resort to it when necessary.

Fisher was getting gobby because another policeman had pushed over a smartly dressed black gentleman, twice!!!!!

Smellie had been spoiling for a fight for some minutes before, clad in what looks like non-standard arm protection and having removed his collar numbers.

When Smellie was "defending himself" he was surrounded by dozens of other officers, none of whom batted an eyelid (or even felt it necessary to turn around) over the incident until the crowd started chanting "shame on you"!

A "near riot" did nearly occur as a result of his violent actions, and he was lucky that his fellow officers (who were not dressed up like ninjas) were able to calm the situation down!

My original point was (trying to bring things back to topic) is there seems to be different rules depending on who is in the dock! Maybe there would have been a different outcome if Smellie (or Higgins) had had a jury trial?

How can this petite female cause harm to a hulking great police officer? Riot or not there can be no threat at all. I'd see a threat in a 6ft+ bloke carrying a metal pole or piece of wood ... can't see it at all with a female carrying a brolly / nowt.

You can't see the rest of the crowd and as I said before, in those situations, you can't take that risk. It was a near riot (12 or more people.....) It doesn't matter how big he was, she was warned repeatedly by him and she watched him draw his baton - why did she think it was still a good idea to have a go. How was the police officer to know she wasn't armed with something?

We have gone away from the ideas that a threat is from blokes only. The females at a demonstration are all feminine and will only hit you with their handbag. Females can be just as violent as males and cause just as much injury.

By the way, as far as I can see, he was wearing his epaulets. He had a reflective tabard over his uniform and the epaulets were on this.
