Thumbs down Amazon - trying it on!

Spent a small fortune with Amazon this year, as I have done every year they have been trading .... this Xmas it has been no different - spent £££££'s with them.

Had an issue with the non delivery of an item from one of their market traders, but never had cause for concern with Amazon themselves - until an hour ago!!

Ordered a Duracell Battery from them, as a back-up to my Canon Battery, for my DSLR Camera. It arrived yesterday, excellent, charged it up overnight.

Put it in my Camera today - Nothing!! Put the Canon back in, perfect (except it had now zeroed all the date and time!?) Reset the date and time - removed the Canon Battery and put the Duracell Battery in - Nothing! .... Canon Battery back in, perfect, but again asking for date/time to be reset!

No bother, I thought, a call to Amazon will see me right ....... hmmmmmmm ..... rang them on their Freefone number (good) - answered by someone I had difficulty understanding (not so good).

She went through the order and the fault - told me she would order another (good) - I would have to send the faulty item back to them (fair enough).

She confimed a new order and instructed me to send faulty battery back, I asked how I would get my postage refunded - she said I wouldn't! (bad and illegal!!!!!). I stated my consumer rights and, as the conversation was being recorded, gave Amazon notice that I will take any action I consider necessary to recover my reasonable postage costs - the costs involved will form part of my claim, which will be more expensive to Amazon than the retail cost of the original item.

She then said she would print me a return label to use - she waited and then said it would not let her. Your problem I said. The system is saying it is a hazardous item and therefore she cannot take a return!!

Now she says throw it in the bin .................

Anyway, that's beside the point - Amazon knows that it HAS to refund postage if a faulty item is returned - attempting to refuse customers their legal rights is bang out of order!!

Bad move Amazon!!

Let's hope that the replacement battery works! Or ot could get interesting!

I remember speaking to people like you when I worked on the phones ... everything is personal and everything is going to be taken further...

I assume you're talking to India? you'd be surprised how much a threat like that means nothing to companies like Amazon and even less to the agent trying to bang through as many calls as possible..

Chill out .. be polite and don't quote what you expect, its sad ..

Its pointless using the phones when trying to sort stuff like this out, the staff are not trained in the legal aspects, they have no need to be, they have departments that deal with this sort of stuff.

Just write a letter, mention the Implied Conditions of the sale, the Fair Trading Act 1999, the Trade Practices act 1974 and the Distance Selling Regulations.

In the mean time, take reasonable care of the product, as you have now rejected it, it is there responsibility to collect the item at a time and date that is convenient for you or they will order you to destroy it.

Order a new one from some ware else and await your refund.

Depending on your Canon model... compatible batteries were 2 for £10ish last time I bought some.

My experience has shown me:-

1. Be polite but assertive

2. State EXACTLY what you need to happen to satisfy you

3. Make it absolutely clear that you are giving notice of your intention to take matters further unless you receive 100% satisfaction within a reasonable time

4. Take that threatened action sooner rather than later - if you are in the right, you win - every single time

5. You have every right to be smug - you have stood up for yourself and won

Who delivered it? I would've thought it was possible for whoever delivers your replacement, to take the broken one. Collection on delivery.

Funny isn't it, Lisa - the Royal Mail delivered it normal post ...... yet Amazon's system says it is hazardous to return through the mail ..!!

Maybe they don't know what condition it is in and cannot accept responsibility? I guess I could have a leaking battery and it could cause health and safety issues?

Anyway, they have seen sense and will replace - Duracell will refund Amazon another ... the costs involved are so small it hardly makes sense to pi55 a customer off over it - certainly not one who took CURRYS to Court and won

Fair enough, it's it's coming through the post they probably can't do it.

Well, it's all worked out in the end.

I can't help but imagine you on the phone telling them the tale about how you fought Currys and won.

Old story now ....... but, yes, CURRYS had to pay for new TV and for all costs - I got to keep old TV too

Is this less to do with Amazon or getting feedback/ a rise here

No need to fly anywhere.

Got my new battery coming and I don't have to send the dodgy one back.

Point of the post was that Amazon, amazingly, were stating that they would not refund postage - which is in direct contravention of consumer law.

I like to think that, far from getting a free battery out of them, I am getting a working battery from them ........ just what my order said, oddly enough!!

They are lucky I am not claiming for consequential losses!

Talking of consequential losses My brother borrowed my 500d for a few minutes on Boxing Day and put his SD card in to take some photos. He neglected to tell me he reduced the quality down from full quality 15M smooth to crappy 8M block shots - Bastads!!! The shot I was hoping to share with you is now junk imho

Ahh well - will share in any case soon-ish
