Help - Item purchased from net damaged
Hi,
I bought a Bosch induction hob a week ago for my new kitchen, the kitchen fitter opened the box today and the whole glass panel was smashed.
I called Bosch (bought from them directly) who advised that I should have called within 48hours to report any damage .
As the box was not damaged I never checked, they have told me its now my problem.
Any ideas??? the bloody thing was £550

The Consumer Protection Regulations, commonly known as the Distance Selling act, state the time as 7 working days to cancel the contract for any reason, how many working days has it been?

was delivered 6 working days ago, apparently the paperwork says you must check for damage within 48 hours.

As you reported this damage within the 7 days i feel you should be compensated.
get back onto the phone and tell them the item has arrived damaged and if they wont accept liability tell them they can collect the goods as they are un-usable for the intended purpose supplied.
Also if you paid by credit card call them up and explain what has happened and you would like to put hold on the transaction as they have supplied you with busted goods.
Just a tip if you ever sign for any goods be it at work or at your front door always sign goods unchecked beside your name , this covers you from this better.

I do this. Then a while back I bought something on the net and the site advised that the item MUST be checked before signing and not to sign 'unchecked' as they wouldn't accept it later. When the item arrived I helped the driver carry it into the house and then I said right I'd better check it. He wasn't happy and said to sign it unchecked. I told him of sellers request and that I HAD to check it (it was a breakable item). He was going to get arsey until I showed him the website and their request, I then said would he spend £250 without checking it. Of course not was the reply, so he had to wait. He did say that he'd refuse to deliver any more for the seller though.

A company can't use their T&C's to get out of the requirements of the Distance Selling Regulations, so the 48 hours they quote amounts to nothing. If it was a business to business transaction, however, they might be in with a chance of enforcing that.
