Unhappy CSA - Ar5eholes : Advice from SN Please

My brother got divorced, 5 or 6 years ago.

3 Kids, 16, 12, 8

He has been paying the full CSA amount plus private top ups when he could (Pocket money, clothes, food, holidays, even for a considerable period actually having all 3 kids staying with him - which he loved)

Situation now is that the youngest 2 stay with Mum and the eldest stays with my brother.

He was obliged to pay £400 a month towards the CSA tariff until the ex wife (who is now co-habiting with another wage earner) decided to ask for a review)

The CSA contacted his employer and asked for the last 2 months earnings.

As he had pulled in a few deals recently - he earned net of £3K a month.

The CSA now want him to pay £800 a month!!!

His bonus won't be ongoing

His normal net take home is about £1.9K

He has all the bills that you and I have and if he is forced to pay £800 a month he will have to sell his house as he won't be able to afford the mortgage.

Surely this can't be in the interests of the kids, who visit daily.

Shouldn't the fact the ex has set up a new relationship with someone who lives in her house and earns a decent wage (fireman) be taken into account???

I wish I could help my younger brother but I just don't know enough about the law. I have suggested going to Citizens Advice but most of those seem to have been shut down nationally.

Any Advice out there????

I don't know alot about this, but can he not get in touch, to explain this is not his normal takehome? I would have thought if he can provide information which shows this is not normal, that it would have to be taken into account.

I won't go into details right now, but my brother came up against the csa fairly recently as they changed the way things are worked out, I believe.

More advice will come, I'm sure, from someone experiencing this.

I think, it makes no difference what her current partner earns or contributes, I know it's not factored in to my brothers situation.

That would work if he wasn't an employee. He's on the edge I love him, he's my brother. I'll be well upset if I can't help him.

This sort of thing really pisses me off.

He's obviously looked after his children since they've split. But now she's got herself a new boyfriend that's earning, why should his contribution have to go up? It should surely go down as the new fella has taken on the ex and all that comes with.

She can't have the best of both worlds.

Might be worth contacting Fathers for Justice, they'll know a fair bit more on the subject.

he should have a chat with the place he works for and tell them whats happening. they prob will do it. he will just give an invoice for the work he has done each week.

A short and to the point letter to the thickheads at the CSA, explaining the facts of the extra money, should sort it. Tell him to enclose his "normal" payslips and perhaps his P60 from last year.

They are famous for going after easy targets, he must stand his ground on this one. Good luck

I would suggest Citizens Advice or a solicitor that specialises in family law.
The CSA always side with the mother and savage the father because the more money they screw out of the father, the less benefits the mother gets from the state.
Your story makes me think of one I heard from one of my customers. In the beginning he paid money to the mother voluntarily and the CSA were not involved. While he worked she was out with her mates boozing and ********. Next thing she's unemployed, starts claiming benefits, and not long after he gets the CSA knocking on his door. She's now playing the pauper and slagging him off at every opportunity, an obvious ploy to get herself as much in handouts as possible. Currently she's shacked up with someone else and he's now not allowed to see his kids because she accused him of kiddie-fiddling.
The CSA are taking nearly half his wages and he wants to kill her, although he seems to have settled on the idea of emigrating to avoid paying.

CSA is just an acronym for persecution. Throw a bitch into the pot and you're in a whole heap of trouble. Your brother needs to deal with this officially right now (no unofficial deals with the ex over tea and biscuits) else he'll never get this monkey off his back.
Best of luck
Kevin

Your brother will have to suffer the higher amount, and then request another review. this make take some time up to 12 months I'm led to believe.

F*cking terrible buisness, I'm sure the CSA must be run by man hating lezzers. They seem to persecute the father for not having the kids living with him when in actual fact he would probably have them in a flash. If only you could cut 'em in half lol. Good luck to your brother as has been said contact the citizens advice.
