Rented house reposesion by mortgage lender

Question Rented house reposesion by mortgage lender

Hello,

Looking for comments or a bit of legal knowledge that anyone can shed on this subject.

We had a visit from the new neighbours yesterday, they've been renting the house next door for about a month or so, direct from the owners.
Apparently they have no contract and have not signed anything of the like.
(They know the owner through work)

They returned home from a holiday late Sunday and opened a letter which I assume was addressed to the house owner, the letter was basically notice of the house reposesion, and it was happening on Monday.

It turns out that the house should never have been let out in the first place, as it was against the mortgage company's terms and conditions.

The neighbours got in touch with the owners, and were told they knew nothing about it being reposesed - sounds unlikely.

Having nowhere to go and not wanting to be kicked out at such short notice, they got in touch with the bailiffs and explained the situation, they were told that if they wanted to stay an extra month it would be £3K. They have now paid £1k and the owners the other £2k.

So where do the neighbours stand legally? Obviously I wouldn't have wanted to be kicked out, but would never have handed over a grand either.

Is there anything they can do with regards to the owners?
Also, how much notice would have been given if the house was going to be repesesed, sureley that's the last thing the mortgage company want.

It looks to me like the owners have known about this for some time but were still willing to put anyone in the house just to get a bit of money.

Anyhoo, I've told them to speak to a lawyer and citizens advice.

Any thoughts or advice I can give them?

Find out who's repossesing it and buy it cheap, then knock through. You'll have a massive garden and big house then

they have no leg to stand on, as the landlord is getting repossessed he/she is immune from any legal pursuits. My advice to them is to source another place as soon as possible.

i would be taking a £1000 worth of stuff from the house to get some of the money back, its going to be snatched back anyway so wont make any differance to the bank

I would be very careful especially if the landlord holds your deposit

Sorry, why have they paid extra: bailiffs £1k and landlord £2k?

Is it a scam?

Just find another place, don't pay anymore money (there's no contract after all). hopefully you/they can get the deposit back and any in advance rent etc.

On the face of it they seem completely fecking crazy to have paid out 3 grand. What's this supposed to get them? 3 months rent?

Of course owners must have known about possible repossession.

Are you sure they are not being taken? All sounds very dodgy.

I think he means his neighbours paid out £1k and the owners paid out £2k.

One day we were on sv's drive way fiddling with the Evo and the owner of his neighbours house popped round and then disappeared shortly before some big fellas turned up asking if anyone knew of the owners whereabouts. Dodgy to say the least. I still think SV should buy it cheap at auction

They have paid extra as they couldn't just up and leave, the bailiffs obviously set their price at £3k so it has been paid.

They are now looking for somewhere else with the month they have been given, I think their problem is they have a dog and not many landlords want one in their property.

Other than that, they really like the house and when it comes to auction they are going to be bidding on it. As someone mentioned above about taking things, i'd gut the place and hope that the amount to be spent would then put people off, thus making it sell cheap, if they win it at auction they could then just put it all back in.

Other than that, I don't think they are being taken but how can I be sure? They have asked the landlord for the details of the mortgage company but they are unwilling to give it. Could well be suss.

There is no way on the god-forsaken place that the owners didn't no anything! To be facing bailiffs and eviction - the owner would've missed easily 3 mortgage payments - in addition the lender would've then taken them to court - if nothing could be arranged and agreed the owner could've asked for proceedings to cease whilst they SELL the house. After that - the court normally hand delivers the paperwork to advise of eviction, normally giving 28 days notice before the bailiffs can come in.

I wouldn't like to say its a scam - but there is definately something off!

As for finding out the mortgage lender - there must be a way. For instance and credit report can show you the mortgage lender - I'd get snooping

bailiff would never take money and let them stay a month does not work that way someone is being conned
i repo house for lenders and they wont not give figures out to anyone who is not on the mortage papers (data protection act)
We are not told how much they are in arrears

Seems very strange then, will see how this pans out. If I see them on the front I might ask if they still have the letter of reposesion, could be worth looking over to see if it looks a bit sus.

£3k was paid for them to stay in a house in Nottm for a month?
How big is the place.. or should I say Palace?

£1k would get you a nice place for almost two months in nottm.


Repossessions don't just happen over night, it would be letter after letter before you got a knock on the door.

No, not yet, making a big one. If I make it big enough maybe next door could rent it off me and live in my garden!!

The story unfolds a bit more, the 1k was £600 rent which was not yet due and they have leant the landlord £400. They're crazy!

Phil, you'll like this bit. They have seen a new build, nice corner plot they want to use one of those government schemes where they buy part and rent the other, lovely location...... Top Valley!!! lol

more house are going 50/50, it's mainly the ones in areas they can't sell.
does top valley have a Bestwood esate post code..... hmmmmmmm nice post code when you need insurance!! lol

All sounds dodgy as. Crazy is right. Shouldn't have paid a penny.
Also I've heard nothing but bad things about those part ownership schemes, there may be plus sides and maybe there are peeps who have not had a problem with them, fair do's but I'm yet to hear good things about them.

Hope all goes well for them anyway
