There are a few threads on SN relating to copyright.
Before you take them to court, it maybe be better to reach an agreed fee in respect of the picture usage, rather than the legal route.
Knowing someone who has gone through the courts with copyright, its the solicitors that tend to end up with the best deal, and the amount you may receive means it may not worth the hassel and the legal bill (there is no legal aid to pursue copyright actions).
Unless you can prove that the "thief" has made a vast profit as a result of your photograph, or there are other legal implications in the way the photograph has been used (mis-representation, defamation of character etc) then use the threat of legal action to get payment.
If its just using your photographs on a website, in a publication or magazine etc, then take the simple route and bill them for it first.
