"The car" - he doesn't even say which one because he's sending these to pretty much everyone trying to sell a car.

Go along with it and wind them up. A previous thread was a great read when a similar episode occurred

The normal scam is that you willing give him the car for what appears to be a genuine cheque. You can even cash the cheque, and wait for it to clear. The funds are almost always placed into your account just as you would expect.

Only about a month later your bank lets you know that it was a fraudulent transaction and takes the money back leaving you with nothing. You of course have no comeback as the car is long gone, and you can never find the person who bought it from you.

Thanks for the replies. I know it IS a scam, I was just wondering what the next move is. I may reply so feel free to suggest an address / message.

Luminous: The interesting thing is that banks are now obliged to honour cheques after 5 days I believe according to new legislation that came into effect a few months ago.

I thought that in the cases of fraud they were still able to reclaim funds. I could be wrong, but the last time we talked about this, the only safe way was cash. Cash that you pay into the bank, and only give the keys after the bank is happy with it.

Technically, even then cash can be reclaimed I believe under some circumstances, but its much much harder.

Check that with your bank. If that is the case then the Nigerian trying to scam you may not actually know this and you could possibly throw the scam back at him. In fact you could ask for another grand

I'm pretty sure I have read some case law in the past regarding CHAPS transfer, and that once the money is in your account it's illegal for the bank to remove it.

Think that applies to UK cheques only A UK cheque is honoured on basis of 2-4-6. 2 days to show in your account, 4 days for funds to clear so you can draw on them, 6 days later it can't be reclaimed even if fraudulent.

A slight digression but how do these scam cheques bounce after months?

Presumably a scammer needs an account at a recognised bank to issue a cheque and it is cleared through a system and the issuing bank releases the money. So how come it is then bounced weeks later? dl

The scammers generally use a stolen cheque book, which is why it takes a while for the funds to be reclaimed.

They have been known to use fake cheques. They look real, and I believe have real account details on the face of the cheque. It takes a while for the real account holder to notice, who then lodges a complaint. The bank then looks at the cheque closely and notices that it has be forged, and therefore reclaim the funds.

Well, I wrote back asking what car he is interested in and when he would like to pay.

I doubt I will get a response, but lets see!

Since Nov 1st last year it is SIX working days and the cheque cannot be bounced any more.

The trick usually is that they give you a cheque/draft for several hundred pounds more than the agreed price of the car. They then ask if you can give the person who picks up the car the extra in cash - all sorts of plausible reasons are given - so you hand over say £750 in cash plus your car and the draft or cheque bounces. Ta ta car. Ta ta cash.
