Company sent me two items but I only paid for one.
I ordered my son a trampoline online last week when the courier delivered it he had two for me. I told him I only ordered and paid for one but he would not only give me one package and said if I don't take both he would not give me them.
How do I stand with this should I phone them up (Big company) or stick it on ebay. How long do I have to keep it before claiming it?

Mate at work had a similar thing before Christmas.
Ordered a Xbox 360 via Amazon, but the internet at work went down when he was placing the order so he re-clicked proceed and ended up ordering 2 xboxes. He phoned up but couldn't cancell. No matter, he sold the second Xbox.
However 2 weeks later a third Xbox showed up. Checked his credit card statement and he hadn't been billed for it. Sold it and made himself £180.

Which is, technically, illegal I believe. It wasn't his to sell etc.
Whether they chase it up when they do their auditing, who knows but I'd guess he's "probably" ok.

Send them a traceable notice (eg fax) to say you have it, it is taking up space, and they should collect it by a reasonable deadline (2 weeks?), if not you will assume it is yours for no payment.

All the real legal stuff is here.
In law (my interpretation of the above) you need to tell the supplier you have it and make reasonable efforts to allow them to collect it. If they don't you can sell it but still can't keep the cash for 6 years.
In reality - keep quiet, wait a few months to see if they've noticed, if not flog it and keep the cash. Be prepared to give them the cash if they do notice within 6 years.

It's not as if he's a benefit fraudster or anything unsavoury like that, is it?

Look at it this way - had you ordered one, and they didnt send you anything, would you be ranting about how they had ripped you off and stolen your money ?
Phone them and tell them about their mistake and let them arrange for the courier to collect it.
If they dont, after a reasonable amount of time ( generally 14 days ) you are entitled to keep it and dispose of it as you see fit.

I'm not sure exactly where you stand to be honest... I'd advise somewhere in the middle but you could find yourself going up and down pretty quickly if you listen to people on here...

There have been various threads about this before. Legally is one thing, but it seems that often it's too much hassle for the companies to arrange collection and they prefer to write it off.
As I said, don't phone, do it by fax so you can prove the date. If they come they come, if they don't you can prove you made the effort and it's their fault.
OTOH I agree that those people saying "keep quiet" could be those who shout loudest when they lose something on ebay...

I see myself as quite an honest guy but if if a big company make a mistake I am going to try and take advantage.
I am getting someone say it's illegal and someone else say it's mine to keep. I have had a look on some sites regarding distance selling but don't see anything.
They sent me a 10 ft and 12 ft one, I paid for an 8ft one but may put up the 12 ft one and sell the other. I will give you first offer on it if I sell Stephen.

I had this happen with an Ebac Dehumidifer - bought it from them and it broke down twice meaning it had to be collecetd and repaired.
They sent a new one to us, and then a few weeks later they sent our repaired one back also - I left it boxed up in the spare room and forgot about it and they chased me on it about 3 months later!!
I would contact them.

Dell sent me two 24" monitors when I'd paid for one and guess what I did? I let them know and they collected it with an apology.
Why did I let them know? Well I'm honest and wasn't brought up to rip anybody off and even though I've been the victim many times, I refuse to join them.

I ordered a 32" Panasonic LCD TV about 4-5 years ago, cost £2,200.
The day of delivery I received a video camera, when I opened the box the invoice was for a guy in Leeds.
Needlesss to say I was fuming cause I was excited at the prospect of my first flat screen TV so I got on the phone and complained. They couldn't explain what happened or where my TV was so they dispatched another one.
It arrived the next day and I gave the video camera to the courier to return.
About 2 weeks later what turned up at my door, the original TV.
I put it in the garage and I rang trading standards, they told me I could do one of the following:
I opted for option 2 and after 6 months I wall mounted it in my bedroom!!
Sold them both about 6 months later.

- Write to the company and advise that if the set is not collected in 1 month it would be deemed a free gift.
- Do nothing and if the company do not contact me in 6 months time I can class it as a free gift.
