MOT failure question ?

MOT failure question ?
Ok, just brought the Mrs a little 1989 F reg Escort soft top run around as her pug spat its gearbox out, now this was found in a garage by a mate where it has stood for 5yrs, tax disc ran out in 06/02.
Now havin changed the oil/ oil filter / plugs / dizzy/ air filter and blead all the brakes renewed both front pads and disc, new rear shoes, new shocks and brake pipes she was running lovely, took for MOT on Wednesday and the guy failed it on a spongy brake pedal, saying rear brakes not working effeciantly ? he noted down on the failure sheet it could be leaking master cylinder ? and nothing else even passed the emissions
Spent all day Thursday draining all the old brake fluid and renewing with new, bleeding all the brakes again, checked, double checked, and triple checked the master cylinder and no leaks anywhere (mate is a retired mechanic who still does jobs in the day to keep him happy) now it was booked back in for its re test today at 3pm, got there and the bloke that did the test in the first place watched as we pulled up, we then parked the car and went over to him and said one failure sheet, brakes all done and no leaks, he then said sorry cant do a retest cos its blowing blue smoke out the back of the zorst ? ?
Sorry mate ? WTF are you on about ? its a CVH they all smoke a bit.
But this guy blatantly refused to re test the car because of this blue smoke he saw ? Now the car has only done 3 miles between test and going back for a retest and it passed the emissions 48hrs earlier.
Question is is what he has said legal ? and can he refuse a retest ? as i was under the impression you only retest whats on the failure sheet ?
If id brought it back a month later i would have expected a full retest but this was less than 48hrs ? ?

bloke sounds like a **** to me,probably be better going elsewhere sounds like the type of person to keep finding something wrong and end up pissing you right off

lol, he's already pissed me off, tis booked in somewhere else now but earliest is next tuesday but needed it for tomorrow tho now she's gonna have to take my scoob so leaving me car less

IIRC, they are only supposed to retest it on the item(s) it failed on in the first place, i.e. the brakes.
Cars can blow blue smoke and still pass the immissions ok, blue smoke out of the exhaust pipe is normally classed as a visability issue as in the vehicle following you cant see clearly, if it isn't that bad, it shouldn't come into the MOT.

Though this guy sounds like a kn*b as stated. But I would go for a good blast first before the MOT to see if the *smoke* reduces.

if its a cvh its almost certainly the valve seals-take about an hour to swap them all with a special tool(about a tenner from factors).
worth doing if only to prevent the oil level dropping too much between checks.

Take it to your local council bus/bin wagon depot where they do MOT's, they have to offer it to the public as well, no vested interest in repairs and a healthy disregard for minor faults, a little drink for the tester helps as well.....

just being a dick really, its not even a cat test on that its just a emissions check, i think its under 4.5 co isnt it? just go back there again saying its not smoking can you please have your retest

He's just worried hes going to blow it up while doing the emissions...
As above valve stem seals harden and descintigrate on the CVH lumps, there is a tool that bolts onto the rocker studs and pushes the valves down onto the piston so you can release the collets.. Makes the job so easy, just dont drop the collets

As far as I know they're meant to re-test everything. I believe new rules say that a re-test has to be booked in for a certain length of time. *I think*!!!!

If you get everything sorted within 10 days - which I have - you can have a partial retest for £25 which only tests the items that failed the first test.
So the mechanic in question is well out of order as he has already passed the car on it's emissions.
Sounds like you should report him to the VOSA and get his testing licence revoked

Hi yes he sounds a bit of a *** but he should do the full check over the car again as they might be a bulb out now or a nail in the tyre ect ect so he is doing it by the book so he is right with that side of it . Hope this helps

if the car is left at the garage for repairs and re tested within 24 hrs it is a free partial retest.if you remove car for repairs and bring it back within 24hrs its half test fee if you bring it back after 24hrs its full test and full fee

Place is CHALLENGER TYRES in BEESTON, MOT tester is Mr D Hopwell.
Best bit is my mates son, who is also a mechanic, works for BEESTON VAN HIRE and this guy does all there MOTS's............but not for much longer
