Help parking ticket
Right, just popped into town, parked on a yellow (or maybe a double), was gone less than 5 minutes and when I returned a lovely lady was writting me a ticket. I jumped in my car and started to move off.
She said "you've got a ticket",
I said "it has to be either attached to the car, or handed to me to be valid"
She said "you'll get it through the post anyway"
Question; who's right?

but, whats to stop her saying you threw it on the floor after she handed it to you pmsl, then ul be in the brown stuff

No, not a hazzard, parked where all the disabled park, no, not in a disabled bay before someone starts, just along the same road. They have a blue badge and I don't, so I get the ticket.

Sorry to be a pain, and put a fly in your soup. You still cn be fined. The ticket can be sent to you in the post, and the fine still stand.
The court case someone above reffered to is where the driver didn't know, or so he said , that there was a traffic warden writting him a ticket.
In your case you knew as you had a chat with her, hence you knew and you've driven off to avoid the fine. Leaving you, I'm afraid to say, liable.
On the other hand, she might not be bothered enough to file the ticket. Long a short of it you may or may not still get the ticket.

Yes, if its the police or someone working for the police (PCSO, traffic warden) then I believe you are stuffed. After all, if a police officer watches you rob someone, its not as if they cannot come after you another day should you escape.
Parking attendants are different. Different councils have different policies, and I do not know if their policies stand up in court. Some have a non antagonistic policy that allows motorists to go on their way should they get back to their car before the ticket is on the vehicle. Others are more hard line, and will try and make you wait.
In addition you have the practical aspect that the warden may just lie and say they placed the ticket on the car. Almost certainly any appeal you make to the council will fail, you will have to get an independant hearing for success. head over to pepipoo to get some advice/ do some research.

You will receive the fine through the post and you will have to contest it. As to whom is right or wrong, will depend on how well you contest it and how the local authority decide. However, technically you were wrong in the first place for parking on the double yellow...... Good luck though!

You are right mate.
Exactly same happened to me... I contested it... saying there was no photo of the ticket on the car, there was no ticket on the car nor was I handed a ticket by the attendant.

Theres no legal requirement to take a photo wilth the ticket on the car, thats just extra evidence to prove the car was double parked, and that the traffic warden isn't making it up.

There was no ticket on the car as she was still writing it! Maybe she took a photo of the car, but, not with the ticket attached.
I guess I'll sit abck and wait.
I do have another get out clause at the moment, which I don't want to mention incase they correct it! Will post afterwards if I need to use it.
