Check this out Anti drink-drive MP fails breath test after crash | the Daily Mail
A case of "Don't do what I do, Do as I say".
What next Brunstrom caught speeding, while doing drugs?

Using the old blood test route
if it had been a specimin from the machine in the nick , it would have been game over there and then..
go down the blood test route,,, and there is always the chance.. that the sample gets lost contaminated or the vials broken

Since it's the Daily Mail there's more outrage than actual information, so it's hard to work out what is going on, but what it sounds like is:
MP had smash. He was breathylised with a standard hand-held unit, which usually over-read - that is, give positives to people who may be slightly under - and was taken to the station for the evidential blood test. That result isn't back yet, so technically he hasn't committed an offence yet. But that's not good enough for Mein Kampf, who have convivted him anyway.
