Angry Drink Driving - Custodial ??


Someone I know, (not a friend!), has been done for drink driving before, and now has got done again, (whilst still under the first ban).

As well as DD. he also has no insurance, no tax, and no MOT.

Don't flame me, it's nothing to do with me, I just want to know the vote.... Is this custodial? And if so, how long?

Id guess at yes, they look upon driving during a ban as a blatent 2 fingers up at the establishment.

Depends on Magistrate, expect a long ban and a community order or equivalent.

This should give this person something to think about before the trial.

Agree, but what type of sentence is he looking at? Couple of months? 6 months?

Will he be able to get at alcohol easily in prison? Is it easy like the movies or will he have to go cold turkey?

I used to be a judge ........ it was a long time ago though

I used to jail the ******* after there 2nd DD offence, 6 months is a minimum i would apply.

Not sure, but he obviously isn't bothered so due to the fact he's no on his 2nd charge, adding to the no tax/mot/insurance 12 months, possibly more as were coming up to the season they like to make examples off people and he is a prime candidate.

Have a look at this page.

It looks like imprisonment is an option even for a first offence so as this isn't his first and with the other factors such as being caught while already under a drink driving ban and with the "no insurance", etc., as aggravating factors, I'd think that a spell inside is very likely. That page suggests that the imprisonment will be up to 6 months (and I suspect that it would be at the upper end of that range).

A 3 year ban is mandatory.

I know someone who got caught for DD a second time within 10 years, although he did have his licence back and was otherwise driving legally. He was multiple times over the limit.

He voluntarily checked himself into a drying out clinic for 6 months. Luckily for him, his employer paid for it.

When he went to court he was told that, had he not checked himself into a clinic, he would have gone to jail. In the end, he got a 24 month ban and a large fine.

Ok, seeing as you asked nicely.

He wont get jailed for the second offence, he will get community service.
Though i would tell your brother that he might be looking at 1 yrs inside & an extended @rsehole. Just to make him **** himself until sentencing

Tried that for 5 years. Doesn't listen, doesn't talk to me. Believe me, I've tried to get through, really tried.

Mother can't help, I can't help.... What will prison teach him?

I completely agree. While I might have some sympathy for someone who goes out in the evening and has a few but does the responsible thing and takes a taxi home, but is then still over the limit the following morning, I have no sympathy with this idiot.

He was banned so should never have been driving at all.

If he was multiple times over the limit, he can't claim that he'd "only had a couple of shandies". He knew he was pissed (and he knew he should not have been driving even if he was sober).

I don't believe that he was unaware that he didn't have insurance and the car wasn't taxed or MOT'd.

In short, ***** like that should not be on the road and as the previous punishment has not changed his behaviour, the best way to keep him off the road would be to jail him for the period of the driving ban.

However, the link I provided says that there is a mandatory 3 year ban for a second DD offence in 10 years and that a jail sentence of up to 6 months is an option. (And I realise that not all information on the Internet is always accurate, but that page did seem to make sense.)

So, in answer to the original question - up to 6 months inside.

Think he'll definately do time, a guy I knew did about 6 months or more on his second DD offence.

Custodial of 3 months+ is on the cards.

I have recently been involved in a disqualified drink driver who was sentenced to 4 months inside and received a further 3 year ban.

Just for getting caught driving whilst disqual usually gets 2 months inside.

Depends on the magistrate, as they can vary wildly.
