sick leave/holiday emplyment question
Hi all
some advise please!
the Mrs works for a small UK company who have a parent compnay in the USA.
the MD is off sick after a bad car smash, punctured lung etc, the finance lady has taken 3 months in one go this year and 4 months last year plus lots of other days, the sales lady has been off numerous times, sickness etc plus maternity leave and now is off for 3 weeks with a hernia (post operation) my Mrs has had 2 days off in 3 years but last week took 9 days (certificated) after an operation (general anesthetic)to remove a lump from her back.
the US has noticed the time taken off and have threatened that everyone has to use their holiday to cover sick days, my Mrs has 4 days saved for Xmas, basically i am asking is it legal for them to force you to use holiday for sickness?

But she also needs to check her contract of employment as her employer usually has a seperate agreement for employees (as in more cash etc...)

Have they said this in writing, or by phone? Seems a pretty stupid thing to put in writing, am sure the Tribunal would have a field day.
Or, do you mean that people get less holiday time in order to cover for someone else's sickness?
Still sounds really dodgy. But I imagine, sitting in an office in Texas and finding your UK counterpart is never present due to a constant stream of dramatic hospital appointments, is not "normal" either.

thanks all, am reading the link now, i suspect it looks very bad due to all the time off, cant really help, i person having hysterectomy, another getting up the duff, one being crashed into while stationary at M6 toll by plonker asleep with cruise control on, or my mrs having cancer lump scare, but the yanks have very differnet holiday/sick pay to uk so i suspect its just noise to stop some of the people who take days off for headaches and not really feeling upto doing anything!

The US are confusing their system of two weeks holiday and two weeks sick days a year.
It's worth checking the contract as some places will say if you take over a certain number of days off ill over a certain period of time, they will not pay your sick pay.
I would politely suggest that they consult a UK employment law specialist before proceeding, as it may save them a tribual or two.

i'm not sure with the US, but they get duvet days and mental health days apparantly, so basically if you cant be bothered or dont feel up to it you can claim the day off!
