Employee rights
A mate of mine is considering reporting another member of his staff for comments made about his wife of a sexual nature.Two comments where made on separate occasions both witnessed,after the first comment he told the person in question not to make such remarks again but two weeks later and again the same guy made another lewd comment.Hes pondering if he should report it to the manager but dosent want to get anyone the sack.What should he do ??

The guy in question is 50 odd!!,the manager has a very very poor approach/track record with discipline,hes only intereted in his bonus,company car,etc.Hes also considering claiming against the company can he do this?

If he has a genuine complaint, he should put it in writing to his company. The company should have a grievance procedure for him to follow outlining how to raise an issue. If he doesn't follow it, he may well weaken his position if the issue goes on.
As you've suggested, if he were to initiate the violence, he'd be in trouble.

Thank sfor the replies,john s I will see him tomorrow and find out how he feels about the situation now.
Can he take action against the company and the employee seperatly,possible tribunral and personal/civil (?) against the employee??

personal choice?.i dont know hes just really p1ssed off with the comments and its strange because hes the sort of guy you could say anything to and he would laugh it off but for some reason this has really annoyed him.

OK afaik the step step is to take it to your mate's line manager, then if an unsuccessful agreement is met the next step is further up the ladder to the manager's boss or to the HR department.
That is policy for 99% of companies.
Failing an unacceptable agreement there then your mate could take on the company, as they had been made aware of the situation and failed to act on it, chances are it will go nowhere or compensation in the 300 note mark would be common, not really worth it imo, as the stigma that will be attached to your mate with colleagues and the like. Only saying but it is a reality, whether it would be admitted or not.
Legally - Harassment is only such if it happens on 2 or more ocassions, which is has, however the timeframe of 2 weeks will be called into play, in that is 2 comments in 2 weeks stressful or offensive enough to claim harassment? I don't know depends on the comments.
This is just for your info and not gospel, but before your buddy decides what to do, maybe an informal word in the boss' ear may help, if he informs him that if it is not sorted he will be making it official. Tell the boss he is making a note of this conversation too.
I would say if the boss is how you say then the most important thing for him will be covering his own a$$ so he doesn't loose that motor...
**Oh and one other thing is that witnesses are only good if they can talk iykwim

Witnesses are more than willing to help,witness 1 heard both comments,and witness 2 heard only the second comment,plus there have been complaints from account holders about this guy before and as i said nothing was done,complaints were of a sexual nature again directed at female staff where he was delivering too.

1/ Gather supporters and evidence/depositions.
2/ Write to manager copying to director.
3/ Tell the bloke quietly that any further filthy implications will NOT be tolerated!
Basically, even if your mate is going to smack this bloke onto his **** he needs to set the scene for it to happen. Actively work so that he can be seen to "snap" and lose it over yet another comment where there are witnesses... and the company has not acted.
Failing that, is your mate's wife handy/large? Would be hysterical to see the bloke flattened by an irate spouse over "comments"....

For gods sake we are turning into the yanks!!!!! lets claim for this and that all the time, has he had an accident at work to, he might get £3k for breaking a nail!!!!! whats a bit of banter at work!
