Default Planning permission

I recieved notification this morning of a developer requesting planning perm to knock down a builders yard behind my property and erect some apartments and some small houses.

I have looked over all the plans and on the hole im not that bothered about whats happening so dont want to oppose it i dont think, however, there might be a way that i could gain access to my back garden from the new access they are creating to the new houses. In the plans though they are looking at planting trees and landscaping directly behind my garden, so do you think it poss for me to ask if they would leave it so i could have access and that way it would save them a little time and money and benefit me!

Why don't you just contact the developer and say you object, and your in the proccess of starting a petitian to stop the development.

Wait for them to ask how much. Pocket a bit of money, then ask about access.

They'll need to fill that hole before they build though. You must go and let them know, straightaway.

If you aren't bothered and it's only down to your property being affected, plus you stand to gain something and the developers stand to save money then I doubt you need telling what to do next.

As a developer myself i get quite a few requests like this and creating rites of way you dont actually want are risky and troublesome so expect a knockback

I understand what your saying matt, but it would just be a case of not planting anything behind my house and me putting a gate on the back fence????

I know it sounds silly but a rite of way is a right of way and can be damned hard to shift once granted.

this is a long shot but have you considered they may want to develop your back garden (assuming there is enough space) and may want to keep the small stretch of land as a "ransom strip" for any future development??

no chance of that mate, its so bloody small they couldnt do anything with it lol!!

the piece they will be 'landscaping' will be approx 12' x 8'.

If you were selling on, it may be disadvantagous to have easy access to the back of your property, for security reasons

but a good selling point being able to get a car on your own land instead of the street!!!!

I thought you meant pedestrian access, didn't realise you would be able to drive a car to your fence!
