Suspension from place of work
One of my friends has got himself in a pickle.
He got himself suspended from work today.
Now the story goes like this ......
His place of work got broke into a few weeks back, an item weighing 750kgs was removed from the premises. The police were on the scene within 20 minutes. The way it looks to all concerned as if whoever done it must have been very strong & seeing as the gate was still locked the must have went another way out. The place backs onto the motorway & is at the end of an industrial estate. Everyone thinks its been as inside job. From what my friend says its not been him. It does look very suspicious also considering the saturday before it was his saturday on with another guy.
So today he was brought in & told that HR were suspending him as there is a few irregularities (sp??) He asked what was & they said they couldnt say.
Now he is unsure if he is getting full pay ?
He is also thinking about handing in his notice as he was offered another job after all this happened.
How would he go about finding out about his pay & also can he resign from his position while there is an investigation going on ???

By law if he is suspended he has to be on full pay. He is also innocent until proven guilty by a court of law and should he decide to leave they have to give him a good reference.
Failure to comply with any of the above will put his employer in the **** and leave your pal open to sue for wrongful dismissal........

No he didnt, tbh it was only worth 5k on the black market & he doesnt need the cash. Previous to this his boss thought the sun shon out his back side.
So he can just hand in his resignation, no ifs no buts ???

That's right, they can't actually 'do' anything...... if he feels that he no longer wants to work for a company that obviously has no trust in him then by all means it's reasonable to want to move on........
He should hand in his resignation and work out his notice (on suspension) and also request a reference from them.
The law is actually with him on this one.........

He should get the terms of his suspension in wiritng and he should be on full pay until the outcome is decided. If a criminal investigation is taking place the police will be involved and obviously any proof leading to charges would be grounds for instant dismissal.
Your employer always has an obligation to let you know the reason for the suspension and should discus this with you possibly in very liitle detail.
Had something similar where one of our staff was working our system to ship things to his home. One of my staff was off sick and his emails made interesting reading to say the least. He resigned very shortly afterwards after becoming aware his emails had been read by management.
Had he not resigned the employee must be given a fair opportunity to explain themselves in an impartial investigation.

By the sounds of it, being paid should be the least of his worries. Especially if the company think it was an inside job

He should leave before he gets a warning, I don't think his current employers can tell the new employers about it unless he actually has one on his record. Had a friend in this situ who was leaving their place of employment and was going to get a written warning for abuse of internet and email (no, not Kenny ) - they HR told him that he could leave there and then and it wouldn't be passed on to future employers - otherwise it would have stayed on record for a year. Catch my drift?

Gardening leave - STILLLLLLL!! Been ages.
If you're doing nothing get your asses through to the Edinburgh festival, catch some shows and take advantage of the extended drinking hours Specially in the outdoor bars - so much more fun drinking outside at 5am than in a boozer

Got another question ... if he resigns giving his one months notice does he still have to appear at a disciplinary hearing if asked too ??

They have to provide him with copies of document/witness statements which concern the allegations along with a letter inviting him to the hearing. He will then be given reasonable time (usually 5 working days) to prepare for said hearing.
Does he have an employee handbook? This should outline the disciplinary procedure of the company, if they dont produce a handbook, he should have had this in writing from them when they suspended him so he's not left in the dark worrying about what is going to happen and when.
I've gone through all this many times as an employer, if they dont follow set procedures in they way they do things, he's able to take them to the cleaners. If you have any specific questions, drop me a PM.
