Who is responsible for loss / damage in car parks

Default Who is responsible for loss / damage in car parks

I know normally all car parks have signs stating that the owners are not responsible for any loss or damage etc... but what if there are no warning signs? can you then hold the owners responsible or just because there is no sign, is it still impied that they accept no liability? Where do you stand on this legally?

Hi mate sorry to hear about your spoiler,

I was told by a solicitor friend that even with disclaimer signs up they still have a duty of care towards your car etc, and that these signs are actually illegal
might be worth looking into
you need to inform the police tho, make sure you get a crime number for later on if you haven't already

Already have mate, they wasn't leaving without talking to them, so got crime number etc. May have to follow this up then.. might be worth trying to get something out of them..

IIRC its only personal injury disclaimers that are 'illegal' / will not stand up in court. They can exempt themselves from responsibility for property damage caused by a third party. However if for example one of their lamp posts fell on your car you would have a case.

Even if there is no signage telling you that you are responsible and not the owners?

So, is the concencus then that the hotel are not responsible or liable for damage to my car even though there are no warning signs that I'm leaving the car there at my own risk?

Yes basically. I don't know what happened to your car but why do you think they should be liable?
