Help - trade in was clocked, trader wants money back
Hi
A few weeks ago I traded in my car for a used car from a dealer. All done and dusted.
3 weeks later(now) the trader is coming back to me saying that the car has had a speedo change/amended. His checks have established that it was done 3/4 years ago, well before I had the car (I purchased it last year from as a trade sale from a trader). When I bought the car last year the invoice said mileage not verified.
I have not said the mileage is correct, nor signed anything to that effect.
I assume the dealer clearly did not do any checks on my old car to verify the mileage/hpi etc. It's only now he has discovered this, 3 weeks later.
He acknowledges that I clearly didn't clock the car, however he wants to find out who did and thus wants the details of the dealer I bought it off (who will state that they did sell the car to me stating that the mileage not verified) but unsure what ge can do with this information.
I was unaware that the car was clocked although the invoice when I bought it said it may not be as the speedo indicates (I assume this is std practice for dealers to cover their ar$e?)
Anyone know what my rights are? Is the trader bluffing as he's adamant he's not going to lose out on this. Should I give the details of who I bought the car off?

Send the guy a tub of vaseline so it doesn't sting quite so much next time.
He had his chance to do the checks beforehand, like you or I do.
If he rings again then tell him politely you have no recollection of the dealers name, unless you want to be dragged into 'carwars' that is.
The clocking happened before your time, you have nothing to worry about.

like a lot of dealers that give you a cooling off period when buying a car, he has well passed any polite gentlemens agreement, so agree with the comments above..stuff him he;s had his chance and you are not obliged. but if you have a conscience, then just be polite but firm and say..sorry i bought and sold it in good faith and sleep easy

What paperwork did you get with your new car. I bet your new car has the same 'mileage clause' as your old one ie mileage not verified. If so, he has sold you the same contract as you had on your old car. He can't have it both ways.

A friend of mine was in a similar situation a few years ago. However the dealer didn't ask him outright about the issue, the sneaky tw*t sent him a letter saying there was a fault on the car they supplied in part exchange. They claimed it was only a minor issue and would take all of ten minutes to resolve. When my friend got there they asked him to drive into the workshop and promptly put the shutters down. Then Steve (my friend) was escorted by two burly blokes to the office where the manager explained everything. He advised him that it was in his interests to comply with them or he may face legal action for fraudelent activities. Therfore Dracoro if you get a letter saying there is a fault with the car just bin it!!

I think the phrase you want to quote him is "buyer beware". As long as the car is fit for purpose, ie not an MOT failure etc then the dealer hasn't got a leg to stand on. And no don't give him the details of who you bought it from as that will just make it even more messy, that is unless he signs an agreement saying he is cutting you out the loop and wont be making any claims against you.

Errr how can he prove its been clocked firstly ? Anything could have been dne to the car since it left your hands and thats really for him to check.

You have done nothing wrong, if the dealer really wants to trace the previous ownership of the car he can do that (I assume) without your involvement, don't get involved would be my advice, do you really want the hassle of ptentially being caught in the middle?

Yep surely its buyer beware just as anyone going to buy a used car. You didnt p/ex your old car with a warranty it was sold as seen so basically the guy is trying to appeal your generous side but he must know damn well there is absolutely nothing he can do. You do not have to tell him where you got it from, there is no onus on you legal or otherwise. If you want an easy way out try and find a local(ish) garage that is no now more and say you got it from there then he's fooked anyway!

Its not going to hurt you to give him the information, so why not help him out since he is suffering a possible loss. I think you would expect the same treatment if you were in his position.

Dealerships try to get as much out of you as possible and when it's not in their best interests they won't help you.
I'd say give him the information if its not too much trouble. Other than that, forget him.

tough on the dealer.Its his responsability to check the mileage and clocking is not illegal its just illegal to suggest the mileage is correct if you know its not.Also you can buy new clocks from dealerships but this does not mean the car is new does it.And its also a known fact that many dealers have clocked mileage in the past and been caught out. Dont worry mate.My job on this website is to spread the word for noone to deal with Adams brothers in buckinghamshire as they welded a roof on my car without me knowing and aepect me to have the car back.A main dealer too!
