Default Law and Adverts

Are adverts on boards like this subject to the Laws of the Land

i.e. they have to be true and fair etc etc

No problem with any ad on here btw, just have seen an advert on a small non related BBS which is so obviously false when I advised "admin" i was told to "get a life" the internet doesn't come under the UK Law

Isn't that what the 'coverall' statement is for though.

This site and all material contained in it blah blah blah, is the opinion of the user and is not supported in any way by scoobynet etc etc slopey shoulders, etc. ?

No - you can't disclaim agains the LAW !

..and in fact as a moderator if you fail to act against a complaint aimed at a BBS content you will end up in deep doo-doo*

Indeed it doesn't that's why hackers doen't get jailed for the damage they cause and internet paedos don't get done for grooming kids and fraud on ebay is just ignored, OK well maybe the last one is true

So if I said a person on scoobynet was ugly and everyone else thought she was 'worth a poke', would I be liable for slander or mis-representation under the provision of UK law, or would I be best just to put a bag on her head and a bag on my head and get on with the job ?

The ASA applies the 'country of origin' principle - if we can determine that an advertisement originated in the UK or the company that hosts the advertisement is based in the UK, we will seek to resolve a complaint. If the advertisement originated outside the UK we may be able to refer the complaint on to our equivalent body in the relevant country.

It's already been tested in UK LAW IIRC and yes if person A slanders person B and the owners / moderations fail to act on complaints i.e. remove thread etc then action can be taken.

I'll try and find the case if I have time.

So if someone insinuated that a thread was 'fit for muppets' and it was later declared fit for NSR consumption, legal proceedings could be taking by the party in the first part thereof de blah legal jargon de blah against the proposed insinuator in the latter
