Get card? Nope, but I did get a court summons!
Well I didn't get a card from Jennifer Aniston I was expecting, but Bath Constab. sent me a court summons for speed camera from the summer this morning. Nice!!
They want me to go to court on the 15th, should i go down or just send em' back he form saying fair cop? Never had a court summons before.
It was a buggar cause they wre doin road works, I was drivin from Devon to London after a wedding, it was the middle of the night, and every 10 mins it was 40, then national, then 50, then 40. I'd gone at 40 for hours and hours, and hours, then speeded up to national to make up some time and didn't slow down quick enough when it went back to 40 and flash flash really early into the cones.
I wouldn't of minded if I had really been speeding the whole time cause I could of made some time up, it was just slackness, slowing down in time, I was just cruising down from national..
67 in 40 zone though, doesn't look good!
Opinions appreciated.

When was the alleged offence comitted? If there is a large enough gap between the offence and the summons arriving, I don't think you can be charged.

Put it in the bin and ignore it, forget about it, dont worry. These things go away in time. The police will forget all about it and you will be free to do things, yes things...
If it was me though, I would naturally dispute the dates (if applicable) and that should be the end of it.
If you have been caught and brought to book within the correct timelines then you must accept the consequences and stomach the punishment.

I thought the NIC (notice of intended prosocution) had to be delivered to the registered keeper within 14 days.
If the car is registered to yourself then they have left it way too long to prosocute you.

There is, however, a time bar to these matters and this should be looked into.

A summons can arrive upto 6 months from the alleged offence date or 6 months +28 days from the issue of the nip date for sec172(2) offence failing to identify.
Questions
Are you the registered keeper of the vehicle named?
Did you receive a nip within 14 days of the alleged offence?
Did you receive a reminder any time later?
How long have you owned the vehicle?
Have you moved address in the period from the offence date till today ?
What is the charge on the summons?
There are defences to be used , pop over to WWW.pepipoo.com and join the fightback forum, post your details as laid out in READ THIS FIRST thread
and wait for the experienced members to give you guidance.
Dont ignore the summons, it will only get worse, firstly seek advice before replying to the summons. You have upto a couple of days before the hearing to enter a plea. If you cant decide what to do initially then plead not guilty as this will buy you several weeks breathing space. you can always change your plea later.

dont forget to ask for the usual calibration certs etc etc and make it as inconvenient for them as possible

Thanks for all this, I left the fricking thing in work, so can't answer your questions precisely. It was basically the end of June, and I think the first letter came through in August. I am not the reg'd keeper, I borrowed the car to drive to a wedding. But they want me to go to court on the 15th of March, which is over 7 months since the incident.
The summons arrived today though.
I'm going to check out that website.

You said you should have dropped to 40 MPH before the cones, was this roadworks? If the normal limit is higher than the imposed limit for roadworks then it is non-endorsable, no points, just a fine.

I remember seeing a a clip on the news or similar about a road in the West Country that had frequent speed limit changes. The road had roadworks which involved the speed limit varying many times.
Anyway, a group of motorists won their case against speeding convictions due to complicated/frequently varying limits.
I am sure a specialist on the above mentioned sites will have more details.

Yeah think I might need to take this one on the chin, bang goes my clean licence record. I'd gone into the cone section on M/W, but I just let the car coast down rather than breaking, cause I was starting to get sick of it, 4 hour journey turned into 8.5!!!!
Did it on the 31/07/2005, NIP sent 08/08/2005 and owner named me straight away. I got a NIP on the 18th and sent it back fairly quickly accepting I was driving.
Got the summons on the 14th Feb 06 with trial on the 15th of March!!
Shall I just send the thingy back pleading guilty then?
