Distance selling laws - Please help quickly

Default Distance selling laws - Please help quickly

Can anyone tell me if holidays are covered within the distance sales act? Basically we got a price for a holiday and it was supposed to be a 3
* hotel - When we finished booking it we found out it was 2*. We also found out it is a complete dump - Basically I called them 30minutes later and asked to cancel it - They want to charge us cancellation fees.

The holiday was booked over the phone and so surely the distance sales laws should apply?

Anyone know any different?

No, holidays are excluded.

As above, from the latest guidance in April 2005.

For online bookings: The right to cancel does not apply to contracts for the provision of accommodation, transport, catering or leisure services (including hotel accommodation, plane, train or concert tickets, car hire or sporting events) where you agree to provide the service on a specific date or within a specific period.

The thing is though, despite the fact they are exempt from the DSR, you might have a good case for being mislead where the 'star' rating of the accommodation is concerned, if it wasn't obvious before paying.

Be careful with star ratings though as travel agencies give these ratings in their brochures and are often different from the international standard

If you paid by credit card then you should pursue the lender for any shortfall.

i had the same thing in nov i paid over 2.5k for our honeymoon only to find that i cant get into america pmsl, a very nice deperate call from my wife to the company bless her the assistant on the phone bent over backwards to help us as my missis put on a few tears, in the end they said ok we can have forget that holiday and book a new one with them but we ciouldnt get a refund

lastminute.com that was, extremely impressed with customer service, the girl basicly spent 5 hrs dedicated to us constant calls to uss to and fro etc
