Stoke parking fines illegal
If you've been fined for parking in the following spots in Stoke then it was illegal. Make sure you get your cash back:
Almost 7,000 parking fines issued by Stoke-on-Trent City Council could be unlawful - paving the way for a flood of legal cases against the authority.
A national parking appeals organisation has overturned a fine issued at Stoke-on-Trent College car park because the council does not own or occupy the land. The city council hands out fines on four other car parks which it does not own or lease, casting doubt on the legality of 6,919 fines amounting to more than £200,000.
The National Parking Adjudication Service, which is made up of specialist lawyers, has ruled a penalty charge notice issued in 2004 to an apprentice at Springfield China in Longton was illegal.
Now Springfield director Philip Jones is demanding the council pays back everyone who has been fined at the car parks at Stoke-on-Trent College, the Potteries Shopping Centre, Octagon Retail Park in Etruria, Century Retail Park in Etruria and outside Lidl in Longton.
Legal experts believe motorists who have been fined at these car parks since the council took control of parking in 2001 could have grounds for action against the authority.

Pah, small fry.
I have yet to follow up the news a few months ago that the Lisbon Parking Authority - the entire body set up to monitor and enforce all of Lisbon's parking places - was not correctly incorporated. Making the entire Authority legally invalid. Together with any tickets it ever issued....

Well, all the decriminalised parking in the UK is also illegal, as Chorley Council recently admitted, because they break one of the fundamental laws enshrined in the 1689 Bill of Rights. So, is that bigger than Lisbon? Hmmmm, maybe not, but it is giving them an awful pain in the neck that is for sure :-)
