Does 12 points always = ban?

Does 12 points always = ban?
My mate's just phoned me with a problem. Up until tonight, he had 9 points on his licence, the oldest 6 of which are 3 years old next July. He's just been done going through a red light and given fixed penalty by the copper i.e. 3 points £60 fine.
IIRC, 12 points in 3 years = totting up ban, but the copper reckoned not.
Anyone know for sure? My advice was obviously talk to a solicitor but I want to give him an indication of what to expect as he's a worrier and will keep ringing me
And yes, he's aware he's worse than Hitler for his appalling crimes against humanity.

Not necessarily, he'll have to go to court and plead his case. Usual mitigatin, hardship (especially to someone else) etc etc.
Chances are if he hasn't good mitigating circumstances he'll get a ban.

If he can prove that he needs a licence for work, or other essential reason, he might be able to carry on driving. I'm sure a friends brother had 13 or 14 points and was still driving

I had 12 points a few years back, took my brief with me, told the magistrates I would lose my job and house etc, and got fined £800 and allowed to carry on driving.
I was warned that should I come before them again then they would instantly ban me.
They also bent my ear about being a habitual speeder, not learnt my lesson etc etc.
My licence had "Driver pleads exceptional circumstances, loss of livelihood" when it came back from DVLA.

He might be ok then. If he gets a letter from his company saying that/ takes a half decent solicitor with him, they might allow it.

It's down to luck on the day imho.
I stood in court with 9 on my license (3 due off the week after my hearing)(all sp30's), with a solicitor, a letter from my employer, a letter from my partner and a letter from her disabled daughters consultant explaining the severe hardship she (6yr old girl) would suffer if I lost mine and the ******* still banned me for 6 months quite happily.
