Default time off work

hi yall

just wondering what the law says in regard to getting time off to stay with your partner if they are not well?

louise is quite poorly and very pregnant , so I want to stay home to look after her, however theres no holiday available and I cannot get hold of my manager at work to get an emergency days holiday authorised.

the nerve centre at work which I have to book it through refuses to do it and states it must be my manager that authorises it.

what can I do?

Im certain that you are legally entitled to the time off in this circumstance. If youve got legal advice with your home insurance then theyll be able to confirm and being able to refer your employer to the relevant legislation will help no end.....

I disagree; it has nothing to do with the companys rules, nor the opinion of the person who deals with it. The law specifically allows for an employee to be absent from work in the circumstance that James has described. I believe that it is at your employers discretion whether the leave will be unpaid or deducted from your holiday allowance.

Didnt this happen to you before James? I think that the issue is whether the person is regarded as a dependant; which your pregnant girlfriend certainly is.

I have just talked to her, she said that she cannot authorise it at this time as its too busy! she did say that I could take her to the doctors and then return to work afterwords, but then I am leaving her alone after that time as no one is around. wtf!

im so mad.

would it be the same if it was her partner? I think not.

I think that the person that youve spoken to is mistaken; it doesnt have to be authorised, its your right. Five minutes on the telephone to your contents insurers legal advice line will sort it out Im sure. You need to get a new job fella.

Read this..... This is a quote from the DTIs website: "FAMILY EMERGENCY?
YOUR RIGHT TO TIME OFF (PL506)
Emergencies happen!

In many cases you now have the right to take time off work to deal with an emergency involving someone who depends on you. You can’t be penalised by your employer for taking the time off, providing your reasons for taking it are genuine.

So who counts as depending on me?

Your husband, wife or partner, child or parent, or someone living with you as part of your family can all be considered as depending on you. Others who rely solely on you for help in an emergency may also qualify.

So what counts as an emergency?

An emergency is when someone who depends on you:

is ill and needs your help
is involved in an accident or assaulted
needs you to arrange their longer term care
needs you to deal with an unexpected disruption or breakdown in care, such as a childminder or nurse failing to turn up
goes into labour"

As you can see you are perfectly entitled to take emergency leave, its your right rather than your employers grant.

its sort of sorted now, I have managed to arrange for louise's mum to look after her after work (she has been allowed to finish early) but that still meens that I have to fetch her from her mums tonight and bring her home, its just a pain in the ****.

I really thought the company I worked for were better than this.

I think its time to find something else.

They cant prevent you from having this time off. In circumstances like this it isnt the company though, its the inept and ignorant members of staff that they trust to administer its day to day running.
