Angry just got shafted on my mobile contract..

I had the Euro200 deal..
I got 90 mins and 50 texts extra FOC..

contract 'ended' at start of may.
I called up and based on comparing the deal with others, renewed.
then had to upgrade my phone as old one is fubar.

all peachy.


yesterday I get my new bill.

no free texts
and only got 200 mins FOC
WTF

phoned up and asked what was going on..

turns out, as I renewed - the offer was time limited (one year)
and as I upgraded my phone I am tied in for one year

F*CK!!
so as a result I am now on a comparatively crap contract, with no way to get out..... ARGHHHHHHH


(i know, I should have read the small print a year ago... but after a YEAR would you have rembered what it said???)

Do distance selling regs apply - so you can just return the stuff and get out of it?

isnt there a 7 or 14 day cooling off period that applies here ?

im 8 days in
no wonder they didnt call me back on saturday (the 7th day would you beleive it)... as I would have told em to run and jump..

Chrome - How many days have you had your new phone? I'm not sure but the 7 day cooling off period is for services (airtime in this case) but also you have 7 days from the day you received the phone (goods).

Maybe they will say they'll have the phone back but the airtime contract still applies but it's worth a try if you haven't had your phone 7 days.

Also I'm sure as your existing contract ended then you should have received details of the new contract and not had to rely on the small print of a contract that has effectively ended.

must admit- I have had NO new contract sent thru post....
no doubt the old one does include the 12month extra mins/texts... need to dig it out.

proper p1ssed off I can tell you.

cant you change the priceplan for there cheapest ever one, and throw the simcard away?

it will still cost you (but not as much?), but you could always go with another provider?
not sure on your costs etc etc

Distance selling regs say 14 days, afaik, so get on the phone pronto and send a recorded letter saying you wish to cancel. Don't take no for an answer.

As said above, you DO have 14 days to cancel. i returned a phone and contract to phones4u, within on the 10th day.
Record everything you send, and keep proof that you sent it, as you will probs need it.

Guys,

Just all be very aware that some of these deals do seem to good to be a true. Our company now does mobiles and good deals but we cannot compete with some of the deals out there because basically there is something hidden somewhere as there is no such thing as a free lunch! We typically can do cashback on new handsets depending on the model but fix the line rental at a standard rate and can sometimes bung in extra mins and text depending on what offers the networks are running for that month. All these deals where you get cashback after 6 and 12 months are because they can upgrade you and make extra money or they use the commission to subsidise the line rental for a set period of time. I bumped into a friend of mine who managed to get a Motorola V3 with 1000mins off peak for £5 a month for 6 months, he's gonna get clobbered in 6 months time to make up for the shortfall simply because the cost of the phone and subsidy will be more than the commission the company would have made and no one gives money away!!!
