Redundancy - how long before position can be re-filled?
When someone gets made redundant due to "re-structuring", how long can it be before somebody is employed in the same position, doing same job??
If the job is the same, surely the job title is irrelevent in the eyes of the law??
Ta.

talking of redundancy... any ideas if....
there are 11 people in a certain position, but one is out of the office for a long-term period, where do you stand if there is a restructure and they make the role into 10 positions??
can the person who is out long term ask for redundancy even if they have been told they are still considered to be in the said role???? - even though the compnay hasnt confirmed how the 11 people will fit into 10 places??
hope the above make sense...

The person can't ask for redundancy (officially), they can only be offered it. So, it really depends if they want them to stay or not.

Remember, redundancy is a way of sacking someone without actually sacking them - it's a kind of legal dismissal. They've done nothing wrong, except they may just be crap at their job and/or just be a total ***.
