Default Returning goods/ My rights?

Bought a Matsui DVD recorder from Curry’s today as a Christmas present, got it home and set it all up......

What a pile of **** it turns out to be, not at all happy with it, very user unfriendly and the remote doesn’t work to well, you have to really push down hard on the buttons to get it to work.

So I wana take it back and get a full cash refund on it but the receipt says that the product must be Unopened/ Unused which it isn’t.

So where do I stand?

Can I expect a full refund?

What should my approach be as I don't want to be fobbed off by them...

sale of goods act 1979 ammended states.

" the goods must be fit for the purpose intended.

and "of merchantable quality"

one of which will suffice,

failing that, just state chrimbo gift, unsuitable bought yesterday...

i had similar this week, bought a mobile from Phones4.. (pressy) wasnt sure but!!

anyway saw a better deal in come* but they state you cant return a mobile if not suitable if box opened.. wtf.. 02 have a 14 day return policy!!!

anyway phones4.. accepted the phone back no probs,,,, mind you the misselling of insurance narked me be aware!!!

i think its a currys / dixons thing...

but your legal rights are just that... take it back

IMHO don't think either of those two will "wash".

I'd go with, my brother / sister / whoever has already purchased the dvd recorder present for so and so, please can i return this one? (The other is already wrapped).

Make sure everything is as it was, should be all ok.

Yours is the option i would use, but if all else fails, it helps to know the relevant clauses

They don't have to change it as actually nothing wrong with it. Most firms nowadays just change things anyway as they can't be bothered with all the hassle of refusing. At least think of a good excuse, not that it is user unfriendly They'll just think you're thick

..you broke the seal to check the contents before wrapping. (batteries for remote, plug for dvd, check to see if it was "new" or whatever you like.)

Take out the fuse and tell them it's broken. If they don't give you your money back, they may give you a brand new one in a box. DO NOT open this one and go to a different store.
