Work security poles damage sumps - whose responsible?

Default Work security poles damage sumps - whose responsible?

At work we have 3 parking spaces that have security poles in front of them to stop the public using them. We share the car park with a Chinese restuarant and a beauty shop and there is a sign that says "Private - No Parking" so our car park is private and not for public use.

However, people do park in the car park to collect food from the chinese and sometimes they park in our spaces if the poles are down. OK, no big deal, but in one space the tarmac is slightly uneven so when a low car goes over it, it can hit the sump on some cars.

This morning theres a fresh trail of oil leading from the pole out onto the main road which makes it at least 4 cars that have been damaged including my old BMW. The Chinese have spoken to us about it in the past as people have gone into the restaurant to complain which in turn has the restaurant owner commenting to us about what has happened.

So, whose responsible? as far as I'm concerned I can't see how we can be responsible. People are not supposed to use our spaces and the whole car park is private parking anyway. No ones ever complained to us but with this fresh batch of oil someone is bound to eventually.

I'd agree with that, your not responsible, they are parking there, at their own risk IMO.... any1 wishes to complain they should be told to pay for the sand to soak up any oil left

In a sensible world you should not be liable.... but in Blair's Britain who knows!

Might not do any harm to add "Cars parked at owners risk - no liability will be accepted for loss or damage" to your sign!

Fit a spark plug to the security poles. That should solve everybody's problems.

Superb. I think all private parking spaces should have 'sump rippers' for those that park where they shouldn't. That could prove to be a very expensive take away!

My suspicion is that you are responsible. I know the organisation I run was sued when a person tripped over some of those flip plates that enforce a one way systtem. The plates were not installed by us, we didn;t want them, but we owned the land so we were sued.

You don;t invite burglars to your home, hoever if they fell in a bear pit in your garden you could be sued.

So I would get the tarmac fixed quickly.
