any help, my step mum got the dreaded envelope this morning

No it was closed about 4 months ago.

There are other potential defences tho' depends on circumstances.

As MattW has said the unsigned loophole is closed, though there have been a few people still slipping through on it because of courts not knowing what they are doing. However, it is not a reasonable defence at this stage.

As was also pointed out Mika over on pepipoo really is leading the charge on the issue that the NIP is illegal under EU law. Some legal experts have determined that the EU has already ruled on this matter. With this in mine your step mum should certainly send the letter on this matter to the CC issuing the NIP. She has 28 days to return the NIP and so should get the letter off ASAP. Even if the CC ignores it having this on record will put her in a strong position when a class action kicks off to sue police forces for attempting to enforce a law which they knew was illegal.

There is nothing at all dodgy or illegal about writing to the CC and so she has nothing at all to lose by sending this letter.
