Question Buying A House

Whats the pros and cons of by-passing the estae agent and doing a deal with
the vendor ??

I realise the vendor will not have to pay comission, 1 to 2 % this way thus i get
the house a bit cheaper But is it all legal to do as the vendor enters a contract
with the agent, would i get in sh!te if i did this deal ??? as i did go through them
to view in the first place.

doesnt the estate agent just sue the vendor and get the commission anyway?

my contract said if I sold to someone without using the agent, I still paid the agent.

if the agents find out they will sue the vendor not you.

It is just a bit out of order to by pass them, as without them you may never have found the house.

must be the easiest way to make money possible ......and no qualifacations required. So approaching the owner directly after seeing the web sites illegal is it ?

If the house has never been placed with an estate agent - you're laughing

Estate agents earn thousands of pounds on each house by placing a £250 advert in a paper that displays 20 houses - rip off merchants

You get the impression every other shop here in Brighton is an estate or a letting agent .......some o them quite poor waitin on the 1 sale ....still mate whos a traffic warden takes great delight in slappin tickets on em at every opportunity

When the vendor put house on the market, they will have signed agreement with agent. One of the clauses will be an 'introduction fee', so if you bypass them after seeing the house the vendor is still liable to pay the agent.

It depends on the contract. You can still market the property privately (through Loot as an example) or if a relative or friend was to purchase it then you'd probably get away with it.

If you were introduced by the agent, then you've only a small chance, if at all, of negotiating without the agent.

Agents go through this all the time, so good luck if you think you're smarter than them.
Up to the vendor really. Will the extra money he gets from not paying the agent cover the subsequent legal fees in fighting the agent when he presumably gets sued for breach of contract?

Much easier in Portugal, where they have no concept of sole agency. I saw the same house through five different agents. Eventually I negotiated directly with the seller. If any agent complained, I would have said they couldn't claim the fee as I'd been introduced by another.

think theres a bit more to it than that, overheads (premises, staff etc)!
