any personel managers on here-i need advice

Default any personel managers on here-i need advice

hi all
last may my wife had a near fatal brain haemorrhage since then she has been on the sick from work unpaid and is now registered disabled
she works for a hospital trust as a radiographer(last 13 years)
the problem being that the personel manager of the hospital has given her 3 options when her sick note runs out at the end of july
1 return to work as normal (no way will she be able to do this)
2 take ill heath retirement (not guaranteed to be accepted)
3 termination of her contract

is this normal procedure?
or is he being vindictive because we forced him to pay her due annual leave(had to threaten legal action before he agreed to it) which was 2 months ago -still no sign of the money

ideally i'd like to go and tear his face off for the upset this caused my wife but she doesnt want me up in court
can i do anything or is the law on his side(regarding the job not the violence)

she is covered by the DDA,so option 1) needs to be explored under this act.I suggest she gets the Union involved,or take advice from a specialist in the DDA.My dealings with this are with much simply jobs,when alternatives can be found quite easily and the employee can be accomodated.i really don't know how it can be applied with your wife,but............the fact that this personnel manager failed to mention it and explore option 1 at all,and just deliver it as an ultimatum,needs exploring imo.The DDA was brought out to protect disabled workers,this situation is exactly why it exixts.The employer is legally bound to explore alternatives and try and accomodate your wifes disabilities.For example,why haven't they suggested an admin job? You really do have a strong case here in my opinion,it sounds like this personnle manager is both ill-informed and naive.

hope everything works out,i would seriously go to a properly trained legal expert in the DDA and take them on,don't give up,its not often the Government produce a piece of leglialation that can help,so use it.

Richie,

I have very personal experience of what you've went through, now one thing I would suggest firstly, if your wife is/was receiving physio, they will be able to advise you quite a lot as to what you're real options are, and not what some ******** is telling you your options are.

OK, not that it probably matters, but I live in N.Ireland, and can put you in touch with a remarkable solicitor who I'm sure could help. This chap was in hospital with my partner during her unfortunate experience (not to disimilar to you're wife's), and takes a very dim view of any forms of discrimination!

tbh she couldnt work as a tealady at the mo
she had an op to sort out the bleed last june
shes got poor short term memory
cant understand linking ideas to form a concept etc
cant stand or walk for more than about 5 mins
major weakness on left side
manager mentioned finding more suitable work but because of the level of responsibility where she works he doesnt think it possible
personally i dont think she could do any job in the forseeable future
i think a solicitor or cab are on the cards
