80-90 in a 40 limit-whats the damage??!
'bro got caught at the weekend.......overtaking a line of traffic at the time..
Will say it wasnt in a built up area, type 40 limit, lots of animals wandering across the road at times,hence the lower limit(he found out after...)
Any1 experience of getting nicked in similar circumstances??

I got caught 33mph over the speed limit which was over the magic 100.. I got 0 pts / £450 / 7 day ban, but was on a dual carrageway.. speeding in a 40 is strictley frowned upon so expect the penalities to be harsh..
Remember the magistrates court is not consistent either, bit like a lucky dip... anything could happen. but would expect dependant on previous to get 6-9 pts / 4-8 week ban / £300-500ish

In fairness, he'd just moved to a new area, and on first impressions the road"looked" like a 60......went for the overtake, and well, there ya go.....
I told him to change his number plates ages ago.......keep em coming!

youll get a short ban and a smallish fine, or a large fine and 5-6points if you convince them it was a one off and you need your license, plus have a good record.. if you need your license for work then a proper letter from your employer and a solicitor for half a day may save your license.

I'd be surprised if any magistrate would contemplate NOT banning someone for being in the region of 40 to 50mph over the speedlimit. I assume the exact figure is so vague as your brother wasn't stopped at the time? How sure is he that hes been done?

Apologies are the Key
Sadly I a few years back I clocked up 81 in a 40 (Dual Carriageway) on a Fireblade overtaking the Caravan Club returning home one Sunday evening
Not Good News for your Bro I am afraid.
Realistically they will be hard pushed not to ban but the key is to get this as little as possible I managed to get a short 7 Day Ban.
Your Brother must show that he is genuinely apologetic and has considered the implications of what may have happened if he hit someone / something.
I put my bike up for sale and showed the magistrates that I had seen the error of my ways and brought a copy of the autotrader.
I also mentioned that I needed a licence for my job (Critical to reducing Ban period). A letter from employer is very helpful.
Overall apologise and appear smart and sincere in the court (You will need to appear in court at that speed ) Respect the magistrates and ideally take a wife/kid along if possible and explain to them that you have responsibilities.
A Clean Licence will help and explain this was a one off and you thought it was a 60 limit and wont do it again.
The bad news is that whatever happens the Insurance premiums for the next five years will be where you really will pay the price.

My mate was caught doing 109 mph on the M40 (70 mph) - he got a 28 day ban, 6 points and had to cough up £4,000 (£3,500 fine and £500 costs)!!
It really depends how the magistrates are feeling on the day...

I got 6 point & £800 fine + costs for 90 in a 50, and was incredibly lucky not to get a ban.
In a 40 he's on a ban, I'm afraid - 7 days if a clean licence, up to 28 days if he already has a reasonable number of points.

BTW, everyone pleads that they need the car for work, have responsibilities, letter from employer saying job is at risk etc. The magistrates hear the same thing for virtually every speeder trying to escape a ban. They are getting hardened to it, unless your brother can point to special circumstances, and I mean the top 5% of special cases, then it won't make much difference.
It's worth trying of course, but I did all the above and got a 42 day ban for less than twice the limit, in a 70mph zone though. Heard every one of the previous 6 accused pleading the same things. The casualty doctor get off best with just a 7 day ban.

Wouldn't like his insurance bill when he drives again - ouch.
If the proof shows he was doing 80 -90 mph I don't think its speeding he will get hit with, it will be dangerous driving which is a far more serious offence.
