Found it a little hard to be sympathetic with the woman who moved into a house 20 yds away from a tram line, who was then "mentally tortured" by the resulting noise! Its like the people who move in next to Heathrow and then complain when the airport wants to increase the number of flights.... not exactly unpredictable is it!

Didn't see the start of that bit, but it was proven that the noise levels exceeded limits, so which was there first? The railway or the house? If the railway, then the house shouldn't have been built there....if the house, then surely the railway company involved should have been aware of this issue when building it? I'm sure Railtrack wouldn't get away with laying a normal train line that close to a house, so how does a tram line company?

Or like sticking your fingers through the lions cage at the zoo then wondering why the signs say keep out, as you say, pretty obvious what i dont understand as she didnt even bother to grow any shrubs there to hide/mask the view and noise my first job would have been to plant some fooking great fir trees down the garden (as much as i hate them)

The tramline was there 2 years before she moved in. I don't know whether the house was there first or not. Her argument was that deterioration of the tracks had caused the noise to increase, which is feasible, but I can't believe it would make the difference between tolerable and intolerable. Even neglecting the condition of the track, one could still argue that it is likley the frequency of trams would increase over the years.

I have no doubt that a peak of 90dB is bloody annoying with the frequency they were going by, but she should have seen (heard) it coming when she bought the house!

I did admire the pikey looking chav with the 4 dogs and cat with her business mind, buy a kitten at £35 and sell a litter of kittens for £50 a throw. Dont know that many people this day actually buy kittens - they're free from any resuce home!
