Damaged alloy wheel through pothole in road how do you claim!!!!!!

My son damaged one of his 18" wheels on Sat night,he hit a bloody great pothole can he claim from the council, anybody ever had this experiance??

What ever you do make sure you go and take a photo of the hole.
Do one of those photos with coin / pepsi can type thing in it to show size comparison.
You can guarantee the damn thing will be filled in the minute you report it. At least you'll have something to show if you do decide to take it further.

take a picture with film not a digital camera, take lots of photos from different angles and showing where it is in the road.

The have a look on your local councils website for a contact for roads and send them a nice letter, if it is in a parish also send it to the parish council.

My Parish has been paying out hand over fist since they rubbish speed bumps were installed, Exhaust, suspension the hole works. Becuase the bumps are illegal, m presuming a great big pot hole will be the same grounds.

For your information I was told by the Head of Transportation at our council that most of the money they have available to them for road repairs ends up being used to settle claims like these. Vicious circle or what

Still, got to look after your own so to speak so get claiming

Almost happened to me the other day. Tried to avoid the pot hole but was forced straight into it by a woman in a 4x4 taking up the whole road [img]images/smilies/mad.gif[/img]

Fortuntely there was no damage, but there was black rubber marks on the wheel where the tire must have been folded over the edge of the rim for split second!

Long story short, you have to prove that the people responsible for maintaing the road are negligent (and therefore liable).
This takes into account :
1) If the fault had been reported previously
2) Regular inspection / maintenance (including the upkeep of records)
3) Acting on reported faults in a timely manner (with a set Service level agreement)
as well as some other criteria IIRC.

I was shafted by the loss adjuster for South Lanarkshire council for a brand new (30 miles) pzero and an alloy.
How you ever know if someone else has reported it is beyond me.
Regular inspection in my case was a quick shifty from a transit van once every year.
As I was not aware that anyone had gone down the hole before me, I could not prove negligence.
The loss adjuster never once disputed the fact that the incident happened, or the extent of the damage (I had photographs and it happened on my birthday on a back road at midnight in the absolute pissing rain).

Probably best putting it down to experience rather than go through the hassle I did to try to get back a couple of hundred quid. I spent ages trying to get the claim sorted and it got me nowhere.

Sorry to put a dampener on the whole thing, but the rules of the compensation culture we live in don't give away money for nothing.

Worth a try though.

They guy i bought my scoob off had a similar claim and got a full set of new wheels. He also repaird the old set and so has 2 sets (winter & summer) WAHEY!!
