anyone had anything legal through yet that is affected by this scheme ??
land compensation act 1973 etc ?
I have just received my claim form & having only bought the house 9 months ago, wondered what claims, property price %, etc I am entitled to.

any advice (that's not stoopid) etc

just me by the looks of things then

I hardly get any replies nowadays, has everyone fell out with me or are my questions just too difficult ??

drevil - I agree that a solicitor will be able to help but I just wanted some background before I went legal. Always better when someone has gone through something like this & can advise on the do's & dont's....

I had a similar situation like this when I lived near the M25 and they put another lane in. A local estate agent, who live nearby, grouped all the claims together and we got a % of the house values at a certain date, that was suposed to make up the loss. It was nothing massive as the Motorway already existing when I moved into the house.

Poor sod now have another 3 lanes going in.

Bloody hell, didn't know anything about this, we live in Barugh Green, just outside Barnsley and close to the M1, we'll be caught up in this too

Is there any information about this somewhere I can look at?

I did quite a few google's yesterday but only found 1 article relating specifically to this part of the M1 development:

I want to know why my solicitor never mentioned this when I bought my house earlier this year or perhaps it wasn't announced??

edited to add "as long as I make some dosh though, I don't really care as I intend to be buried in the back garden of this house"

solicitor should have found this as part of the searches unless this is VERY new. Find out when it was first announced (even as a 'consultation' document) and if this was BEFORE you got the search done, they should have found it.

my thoughts exactly!! surely something this big hasn't just started now, although the letter I received from the chartered surveyors handling the governments/local authorities interests have stated that work won't be completed for 2 years.

It also states that we can't claim until after the improvements have finished, which I find quite strange ??

Also if they are handling this claim & they get all their work from said authority, I bet they pay on the lower side!, which is why I havn't filled out the form they sent me.

I think you'll find that the search only flags up developments planned within ~500m.

Compensation claims are usually paid 1yr after the new road scheme opens and then only to the current house owner. So if you sell your house before and think you've lost money because of a new road scheme it's tough!

ahh, 500m, I park my car on the hard shoulder, should qualify ok then
it mentions in the doc I found on t'internet that 10% or up to a maximum of 31k could be on offer. So how does that work then, do they calculate that figure on my house value when I am allowed to claim, if so I might just escape the falling prices that all my mates keep advising me of
3 years time roughly then to go through "The Fall & Rise of the Housing Market"
