Eddscott - the document in question is a Parental Responsibility Order, however if you've already split up and fighting over access then this will never happen as the partner isnt required to sign it!

Although my troubles are now over I will lend any support I can in getting the draconian law of this land re unmarried fathers changed.

It is very strange how some dads get taken to the cleaners where as others seem to be ignored by the CSA. My dad never had the CSA after him but I think thats more due to both them working it out between them.

I agree that attempting to monitor every penny would cause problems and could increase the risk of both parents falling out with each other even more but just keeping an eye on things when you do see the children should give you an idea. If you gave a few hundred pounds but the child still has the same clothes as last month or hasn't been anywhere and cousin so and so has been looking after them every weekend it doesn't look too good.

I know its slightly off topic but the same thing happens with childcare benefit. The benefit is paid to the individual who then should pay on to the creche'. Our creche' now makes us pay in advance becuase of the single mums who receive their benefit and spend it on carp.

I think it wouldnt be too beauracratic to ask mothers to prove how much they spend on food, how much their mortgage is and then split it into fractions dependant on how many people live in the house:

ie if food bill was £250pm, mortgage, electric/gas/c.tax say £800 = £1050 - divide that by the mother, your kid and the new boyfriend = £350pm - child benefit of £80 (guessing here) = £270pm child maintenance

Just a thought cos a friend of mine pays £296pm and the ex bint drives round in a new 206 - she even had the audacity to complain to him that she couldnt afford a months car repayment if his CSA payment didnt go into her account on time - FFS!!!

Dont get married as they will take into account your new partners earnings the next time they review your payment!

Its a damn ****ing disgrace.

I looked into this issue personally as it affected me for about 18 months a while back - to call it shocking would be an understatement. Unmarried fathers fair alot worse than married ones - the woman can deny your the father legally but you are still expected to pay up.

Slightly off topic but:

Its so draconian - if you're married and seperate but your wifes up the duff by another man then it is assumed in law that the 'husband' is the father until proven otherwise. FFS

Did you now that if a woman names you as the father
you are liable for maintenance until its proved you're not the father and theres no guarantee you'll get your money back.

Think that all those parents who are being illegally denied access by their partners should band together and force changes to be made to prevent this kind of thing needing to be done before people listen.

There is a legal document oyu can get form solicitors that you both have to sign to state the wish that in the event of the death of the mother the child should go to the father. It may well be contested if the parents feel the need but it adds strength to the cause of the father.

OK so the Mother has all the power basically if you're unmarried (and a fair bit if you were anyway) but if they deny you're the Father, why then would you have to pay maintainance? Or have i totally misunderstood?

W69 - if the mother implicates a man as the father the CSA will jump on him asking for maintenance very quickly, however the mother isnt required without a court order to have a dna test performed - and how long can a woman delay a court hearing, how long is a piece of string!!!

Does the Father's name have to go on the kids birth certificate though? Or can they write 'Don't Know' or something?

So really , for example, if i went out and got pregnant i could put any blokes name (within reason!) as the Father and make him pay maintainance until the CSA could be bothered to find out otherwise?? If so, thats pretty screwy.
