Another speeding fine,HELP.
#1
I work as a van driver and got a speeding fine in march 2003 and the 3 points that go with them. Now ive got another one through for the 18th september 2003.
I havent done anything about this one yet as ive only just got the letter through at work.I was wondering if there would be anything i could do to get out of at least the 3 points?? Its still in works hands as they are waiting for me to fill in my details and they will send it back and then i will recive my personal copy.
I was doing 40 in a 30.
Please give me your thoughts on this as i dont really want to go up to 6 points on my licence.
Cheers JON

17 points!!!
Doesn't that mean a ban from driving?
Only way you can get out of it is if you can find someone who is willing to say "i was the driver" and put his details forward... (thats not legal by the way)
Otherwise,as MJW says take it on the chin and be carefull for the next few years.

If the company fill out the NIP to say you were driving then it is likely that you will receive a further NIP for you to confirm it was you driving.
In truth the company don't know who was driving, unless the MD was actually sitting beside you at the time, and so they can only say who MIGHT have been looking after the van at the time. This is far from beyond reasonable doubt and is not enough evidence to prosecute.
Once YOU get an NIP it is then open to you to go the unsigned route. This has been very successful for a lot of people of late. The CPS don't get the papers on your case until the police issue a summons and it would seem that in almost all cases the CPS are dropping the cases unless there are additional circumstances or evidence.
You want to avoid having anything to do with the NIP that work get though and you may want to look into having an "agent" (mate, g/f, solicitor) open and fill out your unsigned NIP form in keeping with the precedent set in the recent case involving Dwight Yorke.
You should also subscribe to the unsigned forms mailing list where you will get to talk with lots of people going the same route and where you will also get to hear lots of success stories.

Remember this is just a money making exercise and if "doing" you costs more than they make then they are not interested. Also, the van can't be the guilty party and unless they have a photo of your face then they have no evidence at all that you were driving on that occasion unless YOU sign the form. So, investigate the unsigned route and see if it works for you.

Cheers for the help lads its given me a little more confidence on how to go about it.
I have been reading about the unsigned route on Piston heads and as you say it does seem to be working.
Cheers
JON.

If you've only just received the NIP for an offence committed on 18 September, haven't they left it too long to send it to you? I thought they had to get it to you within 14 days or soemthing like that?

Amswer is don't speed in built up area's. I am sick to death of idiot drivers wanting sympathy for speeding in 30 limits, slow down and save the speed for motorways or quiet A/B roads.
Why should he get away with it?
I'm no saint when it comes to speeding, but I do respect that built up area's have a speed limit for a reason, for example (in case you haven't worked it out) for the safety of pedestrians and other road users.
And in a van FFS, says it all really, all van drivers drive like tw*ts, IMO.

I don't think there's much you can do about it, just take it on the chin and be careful for the next 4 years. I'm in the same boat if its any consolation (2 nips in a year) and am dreading my next insurance renewal ! Especially since PPP is going to be fitted in a couple of weeks too
I'm not sure what the implications will be for your works van insurance, might be an idea to check the policy if it's possible.
