A have a couple of legal question... Can a traffic warden report a moving traffic offence to the police and you be prosecuted for it?

Does the letter have to be within 14 days of the offence As per speeding fines (if this law does exist)?

Reason being a friend (and no its not me) had a letter through from the local constabulary stating that they drove the wrong way down a one way street at some ungodly hour on a saturday morning. They are requesting driving license details etc and I guess they intend to prosecute.

Anyones help would be appreciated.

Cheers
Paul.

A traffic warden can report for some certain offences, for example failing to obey a signal given by a traffic warden or police officer in uniform, and some failing to conform to traffic sign offences. Failing to conform to a "No Entry" is one of them and they would be capable and authorised to instigate a prosecution.

Failing to conform to a traffic sign is not strictly a moving traffic offence, and if memory serves right, an NIP is not required it is a straight forward booking, so the 14 day rule will not apply.

Ungodly does indeed mean about 9-9.30am

I know this is no excuse, but we are only talking about 5 meters of one way to a two way street - no other road users, perfectly clear visibility across the concrete step that is in the way etc..

Did you pass between a "No Entry" sign?

If so, that is a section 22 offence and quite specific. Even most Police Officers would report you for that!

Most police officers might, but can a traffic warden? You know, those nice people who hand out parking tickets.. thought that's all they could do.

PTMW - 'deliberatly' tell me you never ever.........

Read my original post, there are certain other offences that traffic wardens can report for other than just parking, No VEL for example, as well as some fail to conform offences!

They can report you for not wearing seat belts so what you are asking may well be true.
