Internet orders
#1
I wondered if you guys can tell me what rights I have if any.
I found a DVD/Hard Disk recorder at half the price all other retailers were selling it. I therefore went ahead and ordered it over the internet - my card was accepted and I got an email confirming my order. I realised later that it wasnt just cheap but they had got the pricing wrong and the cheaper machine was at the higher price and vice versa.
This morning I get an email saying they were out of stock and expected no more stock, so couldnt supply the machine as ordered. Now on the phone they told me they had stock so this is obviously a lie to get out of supplying at the incorrect price. But I feel I have a contract. The email says that if it is out of stock then they will advise the estimated delivery - not cancel the order.
Anybody got an educated view ?

If you have an order confirmation, usually supplied via email automatically, then that is your contract.
I would call them up from a number that can't be Caller ID'ed, i.e. call them but with 141 in front to disable the Caller ID their end.
Ask if they have the particular model in stock as if you were going to order. If they have one in stock, then tell them you have a order placed and that you wish them to send it out today.
The "We haven't any stock and won't be getting anymore" is a common method of trying to wiggle out of an order that is in place because their website guys screwed up.
Go get em

We had the same thing happen a couple of weeks back. Graphics cards bought from Ebuyer, confirmation received, then told they were out of stock. They won't supply the cards.
