driving license points - how does it work?
#1
Anyone know the answer to this hypothetical question
if you have 6 pts already, say 2 yrs back, and then gets another 3 pts. Do the old 6 pts go off in a years time, leaving the 3?

Taken from the DVLA website :-
1. Endorsement Guide
Disqualifications, convictions and acceptance of fixed penalties payments in respect of driving offences are notified to DVLA by the courts. The details are entered on to the driver's record and the licence. In addition to paying a fine/fixed penalty the drivers licence will be endorsed with a penalty ranging from 3-11 points or a period of disqualification will be imposed, depending on the seriousness of the offence. Any driver who incurs 12 or more penalty points within a 3-year period faces automatic disqualification under the under "totting -up" system. Information on a driver's entitlement and endorsements are sent to courts and police on request.
Endorsements must remain on a licence for 11 years from date of conviction if the offence is :
drinking/drugs and driving (shown on the licence as DR10, DR20, DR30 and DR80).
causing death by careless driving whilst under the influence of drink/drugs (shown on the licence as CD40,CD50 and CD60).
causing death by careless driving, then failing to provide a specimen for analysis (shown on the licence as CD70).
or 4 years from date of conviction if the offence is as listed below :
reckless/dangerous driving (shown on the licence as DD40,DD60 and DD80),
offences resulting in disqualification.
disqualified from holding a full licence until a driving test has been passed.
or 4 years from the date of offence in all other cases.
That's pants! I thought my points would be off in February but not for another year

Your points will cease to count, in terms of totting up and telling insurance companies, after 3 years, but remain physically on your licence for a year extra.
I once asked someone at the DVLA about this and they said it is to stop people getting their licence "cleaned" before the 3 years are up. It also means that insurance companies that ask for a photocopy of your licence can see if you've got any points that have expired in the last year - which means they can charge you more...

err, yeah. I think the overall jist is:
* 12 points in 3 years and you face a ban
* points stay on licence for 4 years (but only those 3 years and younger count towards your current 12point maximum)

In the eyes of the law IE the fuzz your points stay on for three years but you have to wait four years to get them removed from your liceanse..... I think ??

Are you sitting comfortably??
Points count on your license for 3 years for totting up, eg. if you have 6 points and within 3 years you get another 6 points, under normal circumstances you will recieve a ban.
However, the points actually stay printed on your license for 4 years, after this time you can have them removed.
The reason they stay on your license for 4 years is so that if you are tried for the same offence within 4 years the courts know that you have previous for the offence, eg. you get 6 points for driving with no insurance.. in 3 years and 6 months time you get tried for the same offence.. the court can see that you have been found guity of the same offence in the past and will more than likely give you a larger penalty due to re-offending....

Amanda-Jane,
I'm not disagreeing with the DVLA, I was trying to simplify what the site says.
Mojo,
Yes, you are on 6 points but can't get your licence "cleaned" until 4 years from the date of the offence.

AJ,
The text you quoted says "Any driver who incurs 12 or more penalty points within a 3-year period faces automatic disqualification under the under "totting -up" system."
I think this is the reference to 3 years that Jerome is talking about
Jerome,
Cheers mate
