Free wheeling..A moral dilemma
#1
Ordered a Momo wheel for the PC from a “reputable” on-line dealer. Availability showing was 1-3 days. After a week the status of the order had not altered from “initiating order”, so emailed asking for a status update…. After 48 hrs, heard nothing, so called the only number could find on the site. After some 40 minutes, I was told by the abrupt customer services (!) person that they had none and no, she had not got a clue when they would be in.
I expressed some surprise as the site clearly stated “in stock” and 1-3 days for delivery…pointless really, but made me feel better before cancelling the order. Got an email confirming cancellation and promptly bought the wheel elsewhere.
Guess what turned up a fortnight later from the original dealer. I emailed them (after having checked that my card had not been debited) to say that it was available for collection. Got a reply that the order had been cancelled and in effect doubting that the wheel had been sent at all. Could I send her more details. More details duly sent…cos’ I’m pleasant like that.
Three weeks have gone by and heard nothing. Can I do more? Should I :
A) Persist in getting them to pick up
B) Flog it or give it away as a Christmas present
C) Stare at it for another three weeks

When they reply in writing stating that it has been cancelled and nothing has been sent. I see that as the green light to do whatever you want with it. Although, I'm not a trusting person, so I would be keeping it for a while longer incase they started challenging the whole issue.

joni,
Would you like me to have a word with Mr B opposite? I think you've just acquired a nice new wheel, all you need now is a decent second PC and a bit of networking so that you can be properly humiliated by young C!

As the order was cancelled, it's unsolicited goods. You have informed them the goods are available for collection. I can't remember how long you have to give them (I thought it was a fortnight) but after that it's yours.
Or deny it's existence. If the original retailer asks why you phoned them, say it was a mistake and the extra wheel was a gift from a friend or something

The Unsolicited Goods and Services Act 1971
If you receive unsolicited goods you can:
a) sit back for six months. After that the goods become your property and you can do what you like with them
b) send a letter to the sender giving him/her 30 days to come and collect them. Your letter should say:
that the goods are unsolicited;
unless collected within 30 days you will use them or get rid of them;
where the goods can be collected;
when it will be convenient to collect them.
